Africa-Press – Kenya. <\/strong><\/span>The High court has given Safaricom until January 30 to respond to a case in which a Nakuru-based surgeon is challenging the decision to have Bonga points expire.<\/p>\n

Safaricom in October last year announced through its social media outlets to the public that it has introduced the expiry of its loyalty (Bonga points) including backdated points. The expiry dates and loss of unclaimed Bonga points were planned to take effect as from January 1 this year.<\/p>\n

The matter has now spilt to the courts with Dr Magare Gikenyi accusing the Telco company, the Communications Authority of Kenya and the Attorney General (respondents) of introducing expiry dates of Bonga points without input from subscribers. Magare is a consultant Trauma and general surgeon. He works for the county government of Nakuru and also resides there.<\/p>\n

He wants the court to suspend the public notice and any document released purporting to give effect to the introduction of expiry dates of the Safaricom Bonga points loyalty programme and non-merchandise Bonga redemption (SMS, minutes and mobile data) service.<\/p>\n

Magare who filed the case on December 30 last year says the announcement caught the public unaware. The action of Safaricom he says will affect over 40 million Safaricom subscribers and over Sh4.5 billion worth of Bonga points are going to be lost by January 1.<\/p>\n

\u201cConsidering the verse geographical background of Kenya, high illiteracy level in some parts of the country, lack of internet in some areas and many other factors, many Kenyans will suffer due to poor administrative action of the respondents,\u201d Justice Mugure Thande said the respondents should file their responses by 30 January. The matter will be mentioned on march 6 for directions.<\/p>\n
