Africa-Press – Kenya. <\/strong><\/span>A standoff looms following reports that a section of the County Assembly is mooting plans to kickstart the “regularisation” of developments marked as illegal and unauthorised that were constructed in the last few years.<\/p>\n

A copy of a draft bill dubbed Nairobi City County Regularization of Unauthorised Development sponsored by a city MCA proposes all developments that commenced or were completed before the proposed Act becomes functional be regularised.<\/p>\n

Once the bill becomes functional, the proposal indicates that no building marked as illegal or unauthorised should be demolished. The proposed law is said to be on its way for tabling in the county assembly at any time, with sources hinting that it could be next week.<\/p>\n

If the bill sails through, it will be a big setback given that many buildings that breached construction procedures have collapsed in recent times claiming the lives of innocent residents.<\/p>\n

At the same time, many residents of Kilimani, Lavington, Kileleshwa, Parklands and South B and C have called for the demolition of certain structures in the areas so that the lands are restored to their original intended purpose.<\/p>\n

The movers of the bill are alleged to be senior members of the Built Environment and Land Use Planning Committee. It is argued that owing to a large number of unauthorised buildings in the city, the movers of the bill want the buildings regularised to save developers massive losses.<\/p>\n

Currently, Section 57 of the Physical and Land Use Planning Act says that any development which County’s Executive Committee Member did not approve must be demolished and the land restored to its original condition.<\/p>\n
