The move came at a time when the party is roiled in turmoil with two factions fighting for its heart and soul.<\/p>\n<p>A faction led by former Kieni MP Kanini Kega has written to President Uhuru Kenyatta&#8217;s allied wing terming the convened NDC as illegal and unconstitutional. In a statement on Wednesday and signed by the Jubilee chairperson Nelson Dzuya, the Kega team said Kioni has no legal mandate to summon the NDC.<\/p>\n<p>\u201cYour purported notice of an NDC to be held on March 24 and 25, 2023 is irregular and in breach of our party constitution. I urge you to correct the indiscretion &#8230; Avoid the usurpation of powers that do not inherently attach to yourself as per our party constitution,\u201d Dzuya said.<\/p>\n<p>According to Dzuya, who is loyal to Kega&#8217;s camp, Kioni lacks the legal footing to order a legally binding NDC, \u201cacting on a frolic of his own\u201d. \u201cI make reference to the notice of an NDC, published on page two of the Daily Nation on Tuesday, purportedly signed by you. As you are aware, the procedure of convening a meeting of the NDC is provided in our party constitution,\u201d the letter says.<\/p>\n<p>The letter was copied to the National Executive Committee members and the Registrar of political parties Anne Nderitu. Dzuga cited Article 10.5 that which provides that the secretary-general will convene meetings of the NEC and the NDC on direction from the National Executive Committee.
