Africa-Press – Kenya. <\/strong><\/span>President William Ruto will on Monday know whether the suspension on implementation of the new Finance Act will be lifted or not. The High Court in Nairobi last week extended the orders issued in the case filed by Busia Senator Okiya Omtatah and Lawyer Otiende Omollo pending its hearing and determination.<\/p>\n

In their submission, the duo argues that the state will suffer no harm if the orders are extended and conservatory orders issued. In their case, they have claimed that some sections threaten the right to property, access to justice and violate the Constitution in general.<\/p>\n

Omtata says the petition raises substantial issues of law and the file should be forwarded to the Chief Justice to appoint a bench of judges to hear and determine the matter.<\/p>\n

However, in his application, Treasury Cabinet Secretary Njuguna Ndung\u2019u has asked the court to set aside the orders. He argued that this will bring a budgetary crisis to the government. He told Justice Mugure Thande that the government had continued to lose Sh578 million daily in taxes since the orders were issued on June 30.<\/p>\n

Lawyer Githu Muigai who is representing the CS told the Court that the government will soon be unable to pay international commitments as well as pay salaries of government employees as a result.<\/p>\n

But, the petitioners also told the court that as of now the Finance Act continues to run and that the order does not stop payment of bills and salaries as alleged by the state.<\/p>\n

Defending the Act, Muigai said all the legislative proposals were lawfully and legally introduced to the National Assembly and enacted under the strict provisions of the Public Finance Management (PFM) Act.<\/p>\n

Omtatah and Omollo further told the Court that Treasury and EPPRA have disobeyed the court order and gone ahead to implement some laws in the said Finance Act. They accused the Ruto administration of failing to lower the cost of living and prevent the wastage of public resources.<\/p>\n

The Act has introduced higher taxes that the government is betting on to achieve its manifestos, such as affordable housing and supporting the local manufacturing industry, among others.<\/p>\n
