South Africa is reviewing its <a href=\"https:\/\/theconversation.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;com\/south-africa-is-ripe-for-electoral-reform-why-its-time-might-have-come-157149\">electoral system<\/a> while Eswatini is revisiting the powers of the monarch through a <a href=\"https:\/\/www.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;dailymaverick.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;co.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;za\/article\/2021-11-15-the-king-is-still-bent-on-determining-the-tone-and-character-of-national-dialogue-in-eswatini\/\">national dialogue<\/a>.<\/p>\n<p>South Africa and Eswatini can look to Lesotho for lessons. It\u2019s a fellow member of the <a href=\"https:\/\/www.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;sadc.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;int\/member-states\/\">Southern African Development Community<\/a> and has grappled with these issues for decades.<\/p>\n<p>The three countries share geographic, historical and economic ties. The kingdom of Lesotho returned to electoral politics in 1993, after a long haul of <a href=\"https:\/\/www.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;eisa.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;org\/wep\/lesoverview6.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;htm\">dictatorship capped by a military junta<\/a>.Since then, it has experienced <a href=\"https:\/\/www.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;tandfonline.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;com\/doi\/abs\/10.1080\/10246029.1998.9627833?journalCode=rasr20\">mutinies<\/a>, <a href=\"https:\/\/www.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;airuniversity.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;af.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;edu\/Portals\/10\/ASPJ_French\/journals_E\/Volume-08_Issue-3\/benyera_e.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;pdf\">coups<\/a> and <a href=\"https:\/\/www.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;tandfonline.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;com\/doi\/full\/10.1080\/02589001.2020.1749246\">electoral violence<\/a>.<\/p>\n<p>The advent of tumultuous <a href=\"https:\/\/issafrica.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;org\/iss-today\/lesotho-after-may-2012-general-elections-making-the-coalition-work\">coalition politics in 2012<\/a> laid bare the longstanding problems associated with the prime minister\u2019s excessive powers.<\/p>\n<p>He compromised the security forces, the judiciary, civil service and even parliament, thereby <a href=\"https:\/\/www.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;tandfonline.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;com\/doi\/full\/10.1080\/00083968.2020.1834418\">fuelling instability<\/a>.<\/p>\n<p>The Southern African Development Community has intervened in Lesotho in <a href=\"https:\/\/www.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;eisa.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;org\/pdf\/JAE14.2Weisfelder.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;pdf\">almost every electoral cycle<\/a>.<\/p>\n<p>Its interventions have ranged from diplomatic to <a href=\"https:\/\/journals.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;co.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;za\/doi\/abs\/10.10520\/EJC16147\">military<\/a>. The country is now effectively under the trusteeship of the regional bloc as it sails through a turbulent reform programme.<\/p>\n<p>Nevertheless, there are certain aspects that Lesotho has handled quite well. Its successes offer lessons for other states that are undergoing reforms in similar areas.<\/p>\n<p>First, it has made its electoral system more inclusive. Second, it has curbed the powers of the monarch in a constitutional democracy. South Africa faces a critical period in its electoral history.<\/p>\n<p>The country is <a href=\"https:\/\/www.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;parliament.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;gov.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;za\/bill\/2300397\">reviewing its electoral system<\/a> in the light of a debate that has raged since pre-constitution negotiations in the 1990s.<\/p>\n<p>The <a href=\"https:\/\/eisa.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;org\/pdf\/JAE2.1.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;pdf#page=76\">contest<\/a> is between the proponents of <a href=\"https:\/\/www.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;britannica.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;com\/topic\/proportional-representation\">proportional representation<\/a>, and those favouring a <a href=\"https:\/\/www.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;etu.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;org.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;za\/toolbox\/docs\/govern\/elections.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;html\">constituency-based<\/a> electoral system.<\/p>\n<p>Under proportional representation, candidates contest elections as party candidates \u2013 not as individuals. In parliament, the <a href=\"https:\/\/www.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;ajol.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;info\/index.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;php\/ajcr\/article\/view\/39377\/30302\">representatives occupy proportional seats allocated to parties<\/a>.<\/p>\n<p>The <a href=\"https:\/\/www.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;etu.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;org.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;za\/toolbox\/docs\/govern\/elections.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;html\">constituency-based electoral system<\/a> divides a country into relatively equal territorial units called constituencies.<\/p>\n<p>The system is often credited with <a href=\"https:\/\/www.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;eisa.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;org\/pdf\/faure.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;pdf\">increased accountability<\/a> to the voters by their representatives.<\/p>\n<p>South Africa\u2019s <a href=\"https:\/\/www.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;justice.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;gov.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;za\/legislation\/constitution\/saconstitution-web-eng.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;pdf\">constitution<\/a> envisages an electoral system \u201cthat results, in general, in proportional representation\u201d.<\/p>\n<p>The country has used this system for national and provincial elections since 1994. But arguments over it have never been settled. Occasionally, the Constitutional Court is asked to intervene.<\/p>\n<p>Its first major intervention was in 2002. The court had to decide whether floor-crossing \u2013 MPs switching parties \u2013 was in keeping with a proportional representation system.<\/p>\n<p>It found that floor-crossing at national, provincial and local government levels was <a href=\"http:\/\/www.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;saflii.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;org\/za\/cases\/ZACC\/2002\/33media.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;pdf\">consistent with the constitution<\/a>.<\/p>\n<p>The second time was in 2020. Independent candidates had not been seen as having a place in an electoral system based on proportional representation of political parties.<\/p>\n<p>Then the court was asked to decide whether excluding independent candidates from contesting national and provincial elections <a href=\"https:\/\/theconversation.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;com\/constitutional-court-ruling-heralds-changes-to-south-africas-electoral-system-140668\">was constitutional<\/a>.It decided that <a href=\"http:\/\/www.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;saflii.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;org\/za\/cases\/ZACC\/2020\/11.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;html\">excluding independents was unconstitutional<\/a>.This partly invalidated the <a href=\"https:\/\/www.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;gov.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;za\/sites\/default\/files\/gcis_document\/201409\/act73of1998.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;pdf\">1998 Electoral Act<\/a>.<\/p>\n<p>The decision triggered a <a href=\"https:\/\/theconversation.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;com\/constitutional-court-ruling-heralds-changes-to-south-africas-electoral-system-140668\">search for an electoral system<\/a> that would allow independents to stand for election in an essentially proportional electoral system.<\/p>\n<p>Lesotho grappled with the same questions following its <a href=\"http:\/\/journals.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;ufs.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;ac.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;za\/index.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;php\/jch\/article\/download\/4110\/3694\">controversial 1998 elections<\/a>.<\/p>\n<p>In 2001, it adopted a <a href=\"https:\/\/www.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;academia.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;edu\/download\/72989383\/j.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;electstud.2003.12.00520211017-17059-u63y2z.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;pdf\">\u201cmixed member proportional\u201d<\/a> system, the <a href=\"https:\/\/aceproject.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;org\/ace-en\/topics\/es\/annex\/esy\/esy_ls\">first country in Africa<\/a> to do so.<\/p>\n<p>It remains a species of proportional electoral system, but permits individuals to stand in constituencies, either as independents or sponsored by political parties.<\/p>\n<p>As a result, some MPs are elected as constituency representatives, others as proportional representatives of political parties. The system has performed relatively well.<\/p>\n<p>The <a href=\"https:\/\/lesotholii.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;org\/ls\/legislation\/act\/2001\/4\/ls_amend_4th_2001_og.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;pdf\">fourth amendment to the constitution of Lesotho<\/a> of 2001 can come in handy for the conversation <a href=\"https:\/\/www.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;parliament.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;gov.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;za\/storage\/app\/media\/Bills\/2022\/B1_2022_Electoral_Amendment_Bill\/B1_2022_Electoral_Amendment_Bill.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;pdf\">under way in the South African parliament<\/a> regarding electoral reform.<\/p>\n<p>The lesson is that independent candidates can be allowed to stand for elections in a system that results, by and large, in proportional representation as required by section 46 of the <a href=\"https:\/\/www.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;justice.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;gov.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;za\/legislation\/constitution\/saconstitution-web-eng.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;pdf\">constitution<\/a>.<\/p>\n<p>The most recent <a href=\"https:\/\/theconversation.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;com\/what-lies-behind-uprisings-in-eswatini-the-unfinished-business-of-democratic-reform-171844\">wave of discontent<\/a> in Eswatini reignited calls to reduce the powers of the only remaining absolute monarch in Africa.<\/p>\n<p>The king\u2019s place in Eswatini\u2019s democracy has been an issue since <a href=\"https:\/\/lib.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;ugent.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;be\/catalog\/ebk01:4100000009375057\">independence from Britain in 1968<\/a>.<\/p>\n<p>At independence, the <a href=\"https:\/\/oxcon.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;ouplaw.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;com\/view\/10.1093\/law:ocw\/law-ocw-cd19.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;regGroup.1\/law-ocw-cd19#law-ocw-cd19-miscMatter-1\">constitution<\/a> provided for a constitutional monarch along the lines of Lesotho\u2019s.<\/p>\n<p>The independence constitutions of both countries were cast in <a href=\"https:\/\/academic.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;oup.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;com\/pa\/article-abstract\/36\/2\/218\/1532256\">classical Westminster moulds<\/a>.<\/p>\n<p>But, hardly five years into independence, in 1973, <a href=\"https:\/\/www.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;thepresidency.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;gov.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;za\/national-orders\/recipient\/king-sobhuza-ii-1899-1982\">King Sobhuza II<\/a> of Swaziland (now Eswatini) suspended the constitution and claimed <a href=\"https:\/\/www.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;tandfonline.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;com\/doi\/abs\/10.1080\/10246029.2003.9627233?journalCode=rasr20\">absolute powers<\/a>.<\/p>\n<p>This is still the position despite the new <a href=\"https:\/\/journals.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;co.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;za\/doi\/abs\/10.10520\/EJC53235\">constitution of 2005<\/a>. The king has unlimited executive powers and political parties are prohibited. Discontent over the king\u2019s powers has been growing.<\/p>\n<p>There is now agreement in Eswatini that there must be <a href=\"https:\/\/www.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;google.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;co.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;za\/url?sa=t&amp;rct=j&amp;q=&amp;esrc=s&amp;source=web&amp;cd=&amp;cad=rja&amp;uact=8&amp;ved=2ahUKEwjhmqL4j474AhULXsAKHbSUAHsQwqsBegQIAhAB&amp;url=https%3A%2F%2Fwww.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;youtube.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;com%2Fwatch%3Fv%3D1M9EAOyMJgA&amp;usg=AOvVaw3rKTXbS1bmmWTJG_24fKfW\">candid dialogue<\/a> about the king\u2019s powers, and greater democratisation.<\/p>\n<p>The <a href=\"https:\/\/www.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;sadc.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;int\/news-events\/news\/statement-chairperson-sadc-organ-politics-defence-and-security-cooperation-his-excellency-matamela-cyril-ramaphosa-president-rep\/\">Southern African Development Community<\/a> is facilitating the dialogue.<\/p>\n<p>Lesotho has been grappling with the question of the king\u2019s powers since pre-independence negotiations. Temptations to have an executive monarch have occasionally thrown the country into <a href=\"https:\/\/theconversation.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;com\/the-monarch-in-lesotho-should-be-given-some-powers-but-not-extreme-powers-165914\">turmoil<\/a>.<\/p>\n<p>But it is now generally accepted that executive powers must vest in the democratically elected prime minister. The monarch is cherished but within a democratic system based on multi-partyism.<\/p>\n<p>The people of Eswatini do not have this under an absolute monarchy.
