The polls were expected to be held under a new constitutional regime resulting from a reform process that started in 2012.<br \/>\nBut the process has not yielded much fruit. There\u2019s widespread consensus \u2013 locally and internationally \u2013 that the constitutional kingdom of about 2.2 million people must reform its political system to overcome recurrent political instability.<br \/>\nBut successive governments have failed to bring about the necessary changes. Now, with parliament legally required to dissolve by 14 July 2022 and elections held within three months, there is simply no time to undertake the reforms.<br \/>\nBasotho look set to vote without the much-needed political changes. The biggest deficiency of Lesotho\u2019s political system is that the prime minister wields excessive powers.<br \/>\nThis flaw became apparent with the advent of fragile coalition politics in 2012. In 2014-2015, then prime minister Thomas Thabane capriciously replaced the chief justice, president of the court of appeal, and the leadership of the security agencies.<\/p>\n<p>He <a href=\"https:\/\/mg.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;co.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;za\/article\/2014-06-19-parliament-suspended-amid-fears-of-a-coup-in-lesotho\/\">prorogued parliament<\/a> and changed most of the senior personnel of the civil service. This led calls for reform to grow louder while disagreements in the then tripartite coalition deepened.<br \/>\nThe party of then deputy prime minister Mothejoa Metsing withdrew its support for Thabane and the government, which had a hairbreadth majority in parliament, <a href=\"https:\/\/journals.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;co.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;za\/doi\/abs\/10.10520\/EJC183723\">collapsed<\/a>.<br \/>\nFollowing fresh <a href=\"https:\/\/www.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;reuters.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;com\/article\/cnews-us-lesotho-election-idCAKBN0MD1S220150317\">elections<\/a>, a new government came to power under Prime Minister Pakalitha Mosisili in March 2015. It made reforms its main agenda, but lacked a clear process for executing its programme.<\/p>\n<p>Instead, it was consumed by the assassination of the then commander of the Lesotho Defence Force, <a href=\"https:\/\/mg.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;co.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;za\/article\/2015-06-29-killing-of-former-lesotho-army-chief-deepens-instability\">Maaparankoe Mahao<\/a>, by rogue army operatives in June 2015 .<\/p>\n<p>The country was thrown into instability. The Southern African Development Community (SADC) intervened and established a <a href=\"http:\/\/www.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;dirco.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;gov.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;za\/docs\/2015\/sadc0706.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;htm\">commission of inquiry<\/a> into the assassination and related matters. One of its key recommendations was that Lesotho undertake a comprehensive constitutional reform programme.<br \/>\nMosisili\u2019s government made this <a href=\"https:\/\/www.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;un.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;org\/africarenewal\/sites\/www.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;un.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;org.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;africarenewal\/files\/70_LS_en.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;pdf\">one of its key objectives<\/a> but again failed to make meaningful progress before it <a href=\"https:\/\/www.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;aljazeera.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;com\/news\/2017\/3\/1\/pakalitha-mosisili-loses-parliament-vote\">collapsed in 2017<\/a>.<br \/>\nLesotho held further elections, leading to a government <a href=\"https:\/\/www.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;aljazeera.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;com\/news\/2017\/6\/16\/thomas-thabane-sworn-in-as-lesothos-prime-minister\">led by Prime Minister Thabane<\/a> for the second time.<br \/>\nFollowing a failed reform process <a href=\"http:\/\/www.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;lcn.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;org.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;ls\/news\/REFORM%20PROCESS.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;pdf\">unilaterally designed<\/a> by the government, Lesotho held its first <a href=\"https:\/\/www.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;sadc.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;int\/files\/5515\/4384\/2128\/Multi-Stakeholders_National_Dialogue_Communique_pdf.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;pdf\">multi-stakeholder talks<\/a> in 2018.<br \/>\nThis <a href=\"https:\/\/www.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;ls.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;undp.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;org\/content\/lesotho\/en\/home\/news-centre\/articles\/The-Lesotho-National-Reforms-Bill-to-safeguarding-and-insulate-Lesotho-Reforms-Process-passed.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;html\">paved the way<\/a> for a <a href=\"http:\/\/www.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;lcn.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;org.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;ls\/Resource\/MSND%20Plenary%20II%20Report.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;pdf\">second National Dialogue<\/a>, held in November 2019.<br \/>\nAfter this process, the <a href=\"https:\/\/nra.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;org.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;ls\/\">National Reforms Authority (NRA)<\/a> was established and made responsible for implementing the broad and often vague decisions of the dialogue.<br \/>\nIn 2020, Thabane resigned following allegations that he was implicated in the murder of his ex-wife, <a href=\"https:\/\/www.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;bbc.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;com\/news\/world-africa-52707752\">Lipolelo Thabane<\/a>.<br \/>\nA new prime minister, Moeketsi Majoro, <a href=\"https:\/\/www.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;aljazeera.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;com\/news\/2020\/5\/20\/moeketsi-majoro-sworn-in-as-lesothos-new-prime-minister\">was sworn in<\/a>. The reform programme continued, but exceeded its statutory lifespan without getting a single change to the constitution approved by parliament.<br \/>\nBefore its disbandment in <a href=\"https:\/\/sundayexpress.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;co.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;ls\/nra-challenges-dissolution\/\">April 2022<\/a>, the reforms authority completed its proposed constitutional changes in the <a href=\"https:\/\/publiceyenews.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;com\/parties-pledge-to-salvage-reforms-bills\/\">11th Amendment to the Constitution Bill<\/a>, popularly known as the Omnibus Bill, which is now before parliament.<\/p>\n<p>It is not perfect, but it promises to arrest some longstanding constitutional problems. These include the excessive powers of the prime minister, a judiciary that is controlled by the executive, politicised security agencies, and a weak parliament.<br \/>\nDespite the hype about passing the Omnibus Bill <a href=\"https:\/\/publiceyenews.&lt;br&gt;&lt;\/p&gt;&lt;p&gt;com\/parties-pledge-to-salvage-reforms-bills\/\">before the October election<\/a>, it is almost certain that parliament will not have passed all the changes before its dissolution in mid-July.<br \/>\nIt is expected therefore that Lesotho will hold its poll under the old political design. The main hurdle is that the most critical provisions in the bill \u2013 including changes to the judiciary, parliament and security \u2013 need a two-thirds majority in both the Senate and National Assembly.<br \/>\nSome changes require a referendum. Given the improbability of amending these most entrenched provisions, legislators could cherry-pick and pass the reforms that only need a simple majority vote.<\/p>\n<p>But these changes alone may not make any meaningful impact. The only viable option, regrettably, is for parliament to avoid tampering with the Omnibus Bill and wait for a new parliament to resuscitate the entire reform programme after elections.<br \/>\nIn the last ten years, Lesotho has had five different governments. And every time a government collapses, the reform programme follows suit. These efforts have also suffered from a lack of clarity over process.<br \/>\nWhile there is some consensus about broad areas for reform \u2013 parliament, the constitution, judiciary, civil service, security and media \u2013 there is a lack of consensus about the process of undertaking such thoroughgoing changes to the constitution.<br \/>\nThe fact that the Omnibus Bill is now held up in parliament is emblematic of this problem.
