{"id":40094,"date":"2024-05-13T18:08:24","date_gmt":"2024-05-13T18:08:24","guid":{"rendered":"https:\/\/www.africa-press.net\/lesotho\/all-news\/which-countries-have-joined-south-africas-genocide-case-against-israel"},"modified":"2024-05-13T18:33:27","modified_gmt":"2024-05-13T18:33:27","slug":"which-countries-have-joined-south-africas-genocide-case-against-israel","status":"publish","type":"post","link":"https:\/\/www.africa-press.net\/lesotho\/all-news\/which-countries-have-joined-south-africas-genocide-case-against-israel","title":{"rendered":"Which countries have joined South Africa\u2019s genocide case against Israel?"},"content":{"rendered":"<p><span style=\"color: #ff6600\"><strong>Africa-Press &#8211; Lesotho. <\/strong><\/span>Formal applicants so far are Nicaragua, Colombia, Libya<\/p>\n<p>&#8211; Declaration of intent has come from Maldives, Egypt, Tu\u0308rkiye, Ireland, Belgium and Germany<\/p>\n<p>Over the past few months, South Africa\u2019s genocide case against Israel for its ongoing war on Gaza has snowballed into a larger global affair as a raft of countries have either formally applied to intervene or declared their intention to do so.<\/p>\n<p>The International Court of Justice (ICJ) gave a preliminary ruling in the case in late January, ordering Israel to take all measures within its power to prevent actions that could fall under the Genocide Convention.<\/p>\n<p>It also ordered Tel Aviv to prevent and punish incitement to genocide, ensure aid flow to Gaza, and preserving evidence of crimes committed in the devastated enclave.<\/p>\n<p>Since the preliminary ruling, several countries have come forward to intervene in the case, using a provision in the ICJ Statute that allows third parties to join in proceedings if they consider that they have \u201can interest of a legal nature which may be affected by the decision in the case.\u201d<\/p>\n<p><b>Formal applicants: Nicaragua, Colombia, Libya<\/b><\/p>\n<p>The Central American nation of Nicaragua was the first to formally approach the top UN court.<\/p>\n<p>It filed an application on Jan. 23 for permission to intervene \u201cas a party\u201d in the case, the ICJ said in a statement on Feb. 8<\/p>\n<p>In the application, Nicaragua said it \u201chas interests of a legal nature that stem from the rights and obligations imposed by the Genocide Convention on all State Parties,\u201d read the statement.<\/p>\n<p>Nicaragua considers that the conduct of Israel is in \u201cviolation of its obligations under the Genocide Convention,\u201d it added.<\/p>\n<p>Later on March 1, Nicaragua filed a separate application for a case against Germany, accusing it of violating its obligations under the Genocide Convention and \u201cfacilitating the commission of genocide\u201d by giving Israel \u201cpolitical, financial and military support\u201d and by defunding the UN agency for Palestinian refugees, UNRWA.<\/p>\n<p>The latter case was heard by the ICJ in April, but the court declined the request for emergency measures against Germany.<\/p>\n<p>After Nicaragua, Colombia approached the ICJ in April, seeking permission to intervene and urging the court to ensure \u201cthe safety and, indeed, the very existence of the Palestinian people.\u201d<\/p>\n<p>In its declaration submitted to the court, Colombia said its \u201cultimate goal&#8230; is to ensure the urgent and fullest possible protection for Palestinians in Gaza, in particular such vulnerable populations as women, children, persons with disabilities and the elderly.\u201d<\/p>\n<p>The third country to formally apply to intervene in the case is Libya, which submitted a declaration to the ICJ on May 10.<\/p>\n<p>In its declaration, Libya said Israel\u2019s actions in Gaza are \u201cof genocidal character, as they are committed with the requisite specific intent to destroy Palestinians in Gaza as a part of the broader Palestinian national, racial and ethnical group.\u201d<\/p>\n<p><b>Intention to intervene: Maldives, Egypt, Tu\u0308rkiye, Ireland, Belgium<\/b><\/p>\n<p>The latest country to make any sort of move regarding South Africa\u2019s genocide case is Maldives, which reiterated on Monday its intention to intervene.<\/p>\n<p>This decision has been taken \u201con the premise that Israel is in violation of the Convention on the Prevention and Punishment of the Crime of Genocide,\u201d the presidency said in a statement. It accused Israel of committing \u201cgenocidal acts&#8230; under the guise of security concerns\u201d that have \u201cresulted in mass displacement, acute starvation, and blockage of humanitarian aid.\u201d<\/p>\n<p>The Maldives government had earlier said in late January that it had decided to intervene in the case.<\/p>\n<p>Its new statement about ICJ proceedings came just a day after Egypt declared its intent to join the case against Israel.<\/p>\n<p>In a statement, the Egyptian Foreign Ministry said the decision was taken \u201cin light of the escalating severity and scope of the Israeli assaults against Palestinian civilians in Gaza, and the systematic targeting of civilians and destruction of infrastructure in the strip.\u201d<\/p>\n<p>\u201cThese actions constitute a flagrant violation of international law, humanitarian law, and the Fourth Geneva Convention of 1949 regarding the protection of civilians during wartime,\u201d the ministry said.<\/p>\n<p>It called on Israel to comply with its obligations and the provisional measures ordered by the ICJ, while also demanding urgent steps from the UN Security Council and other stakeholders for a cease-fire and halt to Israel\u2019s invasion of Rafah.<\/p>\n<p>On May 1, Tu\u0308rkiye announced its intention to intervene in the genocide case against Israel.<\/p>\n<p>Foreign Minister Hakan Fidan said Tu\u0308rkiye hopes its intervention would help ensure that the ICJ case \u201cwill progress in the right direction.\u201d<\/p>\n<p>He said Ankara had been working on the matter for \u201ca very long time,\u201d and will soon complete its legal work.<\/p>\n<p>From Europe, two countries have voiced their intention to intervene in the case.<\/p>\n<p>On March 27, Ireland announced it would join the case, with Foreign Minister Micheal Martin saying officials had been directed to \u201ccommence work on a declaration of intervention.\u201d<\/p>\n<p>\u201cIt is for the Court to determine whether genocide is being committed. But I want to be clear in reiterating what I have said many times in the last few months; what we saw on Oct. 7 in Israel, and what we are seeing in Gaza now, represents the blatant violation of international humanitarian law on a mass scale,\u201d Martin said in a statement.<\/p>\n<p>\u201cThe taking of hostages. The purposeful withholding of humanitarian assistance to civilians. The targeting of civilians and of civilian infrastructure. The indiscriminate use of explosive weapons in populated areas. The use of civilian objects for military purposes. The collective punishment of an entire population.\u201d<\/p>\n<p>All of this has to stop, said Martin, asserting that \u201cenough is enough.\u201d<\/p>\n<p>Earlier in March, Belgium made a similar announcement, saying it would submit an application to the ICJ.<\/p>\n<p>However, Foreign Minister Hadja Lahbib clarified that Belgium\u2019s potential involvement was \u201cnot about taking sides in favor or against one or the other party,\u201d but rather an attempt at \u201cstrengthening the universality of international agreements to which states are parties.\u201d<\/p>\n<p><b>Intervention for Israel: Germany<\/b><\/p>\n<p>The only country that has so far vowed to intervene in the ICJ case to support Israel is its staunch ally Germany.<\/p>\n<p>Berlin made that announcement on Jan. 12, even before the top UN court handed down its preliminary ruling.<\/p>\n<p>In a statement, government spokesman Steffen Hebestreit said Berlin \u201cfirmly and explicitly rejects the accusation of genocide,\u201d adding that it has \u201cno basis whatsoever.\u201d<\/p>\n<p><b>Source: AA<\/b><\/p>\n<p><strong>For More News And Analysis About <a href=\"https:\/\/www.africa-press.net\/lesotho\">Lesotho<\/a> Follow <a href=\"https:\/\/www.africa-press.net\/\">Africa-Press<\/a><\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Africa-Press &#8211; Lesotho.
