Africa-Press – Malawi. Opposition Democratic Progressive Party (DPP) leadership crisis rages on as the party’s spokesperson Shadreck Namalomba has obtained permission to apply for judicial review and a court injunction against Leader of Opposition who is also the party’s Vice President of the Southern Region, Kondwani Nankhumwa’s decisions in Parliament.
Namalomba through Zomba High Court, wants the court to review the decision by Nankhumwa who made sitting plan changes in Parliament recently without consulting the party. According to the order obtained on March 9, 2022, Speaker of National Assembly and DPP are first and second interested parties respectively.
“Until a further order of the court, the following decisions of the defendant be and are hereby stayed; the decision of the defendant made on or around 15 February 2022 altering sitting arrangements in Parliament/national assembly by relocating the claimant to seat number 99 and later seat number 100 from seat number 25, the decision of the defendant appointing a shadow cabinet for the 2nd interested party without consultation with and approval of the party and the decision of the defendant appointing parliamentary spokespersons for the 2nd interested party without consultation with and approval of the party.
“Until a further order of the court, the defendant be and is hereby restrained from discharging the duties of the office of Leader of Opposition without consultation with and written approval of the 2nd interested party and the 1st interested party is restrained from acting on or recognizing the decisions of the defendant in the absence of proof in writing to the satisfaction of the 1st interested party and the 2nd interested party has been consulted by the defendant and that the 2nd interested party has approved the said decisions of the defendant,” reads part of the order signed by the registrar
The court has given the parties 48 hours’ notice to Namalomba if they want to vary or discharge the order. Since DPP lost presidential elections in June 2020, there has been power struggle as the its leaders Peter Mutharika is unable to resolve the matter.
