Africa-Press – Malawi. High Court Judge Simeon Mdeza has called for an inter partes hearing on the Leader of Opposition issue. A court document that The Daily Times has seen indicates that the judge will hear from George Chaponda, whose ascension to the position is being delayed by an injunction which incumbent Leader of Opposition Kondwani Nankhumwa obtained, and others on the issue.

In 2022, at least 22 members of Parliament (MPs) obtained an injunction stopping Chaponda’s appointment at that time. On Wednesday, Chaponda applied to have the injunction vacated after he was rejected by the Business Committee of Parliament because of the injunction which remains on his head.

The injunction was granted by Judge Kenyatta Nyirenda but Chaponda has made an application to vacate it before Judge Simeon Mdeza. According to lawyers close to the case, the matter may take long to be concluded.

“The issue will take long to be concluded and, for the injunction to be vacated, he needed to appeal the ruling, not making the application he has made. But I believe that the lawyers know what they are doing. Maybe they are sure that they will have it vacated using the route they have taken,” one lawyer said.

Meanwhile, Member of Parliament for Blantyre City South East, Sameer Suleman, has announced his withdrawal from the case against Chaponda. Suleman was among the 22 DPP lawmakers who obtained an injunction in 2022.

“I’m not proceeding with the case. This is water under the bridge for me,” Suleman said.
