Africa-Press – Malawi. <\/strong><\/span>Alert security guards last week physically handled and accosted former President Peter Mutharika aide Julius Mithi at Shoperite Mzuzu after he attempted to exit the shop without deliberately paying for a packet of sweets valued at MK900.00.<\/p>\n

Several sources at Shoperite including the guards who monitor the CCTV cameras confirmed the incident saying Mithi\u2019s action was deliberate because he had shopped a basket full of other products which he duly paid.<\/p>\n

\u201cI saw him in the shopping aisle picking various products and stashing them in a basket. But when he can to the aisle for sweets he picked one packet and put it into his pocket and not the basket. I continued monitoring him so see whether he was going to pay.<\/p>\n

\u201cBut he paid for the other goods and not the packet of sweets. That\u2019s when we confronted him and took him back to the shop. He paid for the sweets valued at MK899.99,\u201d the source said.<\/p>\n

In October 2020, Sheriffs from the High Court in Mzuzu swept clean of all household properties belonging to Mithi because he failed to pay an insurance claim of MK6.4 million.<\/p>\n

Under Civil Cause number 410 of 2020 Hope Alfred Kairole sued Mithi and General Alliance Insurance Company Limited for negligence driving which resulted in the damage of Kairole\u2019s vehicle and also injuries to him.<\/p>\n

\u201cParticulars of negligence include; failing to give right of way to other road users, failing to control, slow or break so as to avoid hitting motor vehicle registration number KA 9325 Toyota Succeed Saloon, failure to give proper lookout for other road users and generally failing to observe traffic rules, signs and signals,\u201d reads the claim filed in the High Court in Mzuzu.<\/p>\n

According to Court documents, Kairole relied on the doctrine of les ispsa loquitor(the principle that the mere occurrence of some types of accident is sufficient to imply negligence)in that the accident would not have happened without the negligence of Mithi, who was heavily inebriated at the time of the accident. The claim was filed on November 25, 2020 and Mithi never contested it or responded to court summonses.<\/p>\n
