Africa-Press – Malawi. <\/strong><\/span>Lawyers representing concerned citizen Frighton Phompho have applied to the court to be allowed to cross-examine Anti-Corruption Bureau (ACB) Director General Martha Chizuma and three others in the audio recording judicial review case.<\/p>\n

Phompho joined the case, in which Chizuma is challenging an order for her probe over a leaked phone conversation that she allegedly had with a person yet to be officially identified, as an interested party.<\/p>\n

The Mzuzu Senior Resident Magistrate (SRM)\u2019s Court had ordered the probe until the High Court stopped the investigation and instructed that the order be reviewed.<\/p>\n

Now, through his lawyer Michael Goba Chipeta, Phompho wants to cross-examine Chizuma, her lawyers Martha Kaukonde and Wesley Mwafulirwa and another deponent Adamson Kavalo when the case comes to court on Monday.<\/p>\n

\u201cI can confirm about the notice. We want to cross-examine the deponents to the affidavits filed before the court,\u201d Chipeta told The Sunday Times.<\/p>\n

During the last court session, Chizuma\u2019s lawyers asked the court that they would like to establish the true identity and place of residence of Phompho who reportedly comes from Chikwawa but moved a court in Mzuzu.<\/p>\n

After Kaukonde had presented fresh affidavits in the High Court, Chipeta had asked for time to review the documents before commenting on them. Mzuzu SRM Godfrey Nyirenda had ordered the Director of Public Prosecutions (DPP) and the Inspector General of Police to investigate the authenticity of the leaked recording.<\/p>\n

This was after Phompho had asked the court to open a case against Chizuma who he accused of illegally disclosing privileged information about an ongoing investigation to a third party.<\/p>\n
