Africa-Press – Malawi. <\/strong><\/span>Registrar of the High Court, Lilongwe Commercial Division Anthony Kapasichwe has set October 3, 2022 as a day will deliver a ruling on two applications in the Gam Fuels Kanengo Filling Station case.<\/p>\n

Gam Fuels\u2019 owner Gerson Mkweza filed three applications on Tuesday, September 20, 2022. The Registrar made the date on Thursday, September 22, 2022. This comes after Sheriffs sold the filling Station amounting to MK747 million for Masters borehole drilling company.<\/p>\n

Masters owner Alfred Gangata sued Mkweza for loss of business after Mkweza confiscated Gangata\u2019s borehole drilling compressor keys to force him to pay back a MK1.5 million Kwacha debt.<\/p>\n

In the first Application, Mkweza wants Abraham Simama\u2019s company Realsim, removed from the case saying it adds no value to the case. This is the company that bought the filling station from Sheriffs.<\/p>\n

In the second Application, Mkweza wants Gangata to produce business documents for easy determination of the said lost profits. In the third Application, Mkweza wants the court to set aside the ruling, that ordered the sale of the Filling station.<\/p>\n

Jimion Nyanda lawyer representing Mkweza confirmed that the court has set October 3 for ruling on the first two applications which it has heard. He said however, that Simama\u2019s company, Realsim had also applied to vacate interim relief order that stopped the sale of the filling station.<\/p>\n

Lawyers representing Simama\u2019s Realsim and Gangata\u2019s Masters borehole declined to comment on the matter. Meanwhile, the filling station is now in operational.<\/p>\n
