Africa-Press – Malawi. <\/strong><\/span>With the official announcement of Arthur Peter Mutharika (APM) to stand in 2025 and the subsequent ruling that has declared that the opposition Democratic Progressive Party (DPP) must have a convention or political conference in 90 days, only those that are eligible must contest that convention.<\/p>\n

This has made a lot of people including me go back and look at the Constitution critically with some case studies. Firstly, there is a big distinction between a member of the national governing council and a president. if you look at Article 10, sections 4 and 5, then you will grab the distinction. Unless we don\u2019t understand our own constitution because it was copied from the constitution of DPP in Taiwan (now China) and we only fine-tuned it.<\/p>\n

In section 4, the constitution stipulates that a member of the National Governing Council (NGC) can be elected for two terms unless disqualified, but has a chance of another two more terms( please understand the word \u2018more\u2019) section 5 also defines two terms but has indicated that he can extend and remained party president if he or she becomes state president.<\/p>\n

This means a president has only two terms unless he becomes the state president. He is not qualified as an NGC member unless we choose to be confused.<\/p>\n

The Constitution has already dealt with it so we shouldn\u2019t be confused ourselves. APM was elected in the 2013 convention, and in 2014 he was elected state president.<\/p>\n

In 2018 nobody contested against APM as he was within constitution stipulations to the point that he was endorsed without opposition. Unfortunately, he lost the state presidency position where two terms and conditions now apply.<\/p>\n

Therefore APM is ineligible to contest in any DPP convention but has a chance to contest for state presidency as an independent presidential candidate because he had one term as state president.<\/p>\n

APM is only mandated to contest in any DPP convention if the DPP constitution has been amended but with the 90-day ruling and by saying only eligible members qualify (eeeeh pachema).<\/p>\n

APM has one option to seek clarification from court otherwise as it stands an embarrassment is coming.<\/b>
\nMCP John Tembo case study<\/b><\/p>\n

Our case study is Malawi Congress Party (MCP) leadership under the late John Zenus Ungapake Tembo (JZU). He was elected at the MCP convention before the general election in 2004 and 2009.<\/p>\n

Tembo respected the MCP constitution and left his office in 2013 when Reverend Lazarus Chakwera was elected party president. The late JZU Tembo respected mcp constitution and why are we not respecting our constitution yet we call ourselves democrats and law-abiding citizens?<\/p>\n

So, APM must swallow its pride and retire by allowing new blood including Dr. Dalitso Kabambe, Kondwani Nankhumwa, Paul Gadama, and Bright Msaka to compete for DPP leadership ahead of the 2025 Malawi Presidential polls.<\/p>\n
