Africa-Press – Malawi. <\/strong><\/span>Midima first grade magistrate Lameck Mkwapatula has ordered Abdul Raman Javeed to pay a fine of MK300.000 and or in default serve a 14-year jail sentence for causing death due to reckless driving.<\/p>\n

The court heard that on October 7, this year, the convict aged 19 who was overspeeding along Mudi road going in Limbe Cathedral direction hit Hassan Chimasula at Machinjiri junction who sustained serious injuries.<\/p>\n

According to state prosecutor Supretendant Lloyd Magweje, Chimasula was on the same day taken to Queen Elizabeth Central Hospital where he died upon arrival.<\/p>\n

Magweje further told the court that the convict was taken to Limbe police station where a caution statement was recorded and charged with causing death due to reckless driving, a charge he admitted.<\/p>\n

Passing his judgment, first-grade magistrate Lameck Mkwapatula said the offence committed by the offender was serious which attracts a penalty of MK500.000 cash or a maximum jail term of 14 years.<\/p>\n

However, magistrate Mkwapatula ordered the convict to pay MK300 in cash since he was the first offender and admitted the charge. According to the ruling MK200.000 will go to the deceased family while MK100.000 will be used to meet costs incurred by the court.<\/p>\n

Javeed who is a Malawi and of Indian origin admitted the offence. Meanwhile, the deceased family has expressed unsatisfactory over the ruling arguing that justice was not served.<\/p>\n

The deceased\u2019s father Adam James told the Maravi Post that would appeal against the verdict. As a family we consider the judgement as unfair and justice has not been served.<\/p>\n

\u201cWe are to seek an opinion of a higher court. We are not satisfied with the ruling and we will appeal\u201d, says James. The deceased hailed from Mkwanda Village, Traditional Authority (T.A) Mlumbe in Zomba.<\/p>\n
