{"id":55608,"date":"2023-12-30T22:32:35","date_gmt":"2023-12-30T22:32:35","guid":{"rendered":"https:\/\/www.africa-press.net\/malawi\/all-news\/batatawala-son-in-law-jussab-in-court-over-vehicle-ownership"},"modified":"2023-12-30T22:54:29","modified_gmt":"2023-12-30T22:54:29","slug":"batatawala-son-in-law-jussab-in-court-over-vehicle-ownership","status":"publish","type":"post","link":"https:\/\/www.africa-press.net\/malawi\/all-news\/batatawala-son-in-law-jussab-in-court-over-vehicle-ownership","title":{"rendered":"Batatawala, son-in-law Jussab in court over vehicle ownership"},"content":{"rendered":"<p><span style=\"color: #ff6600\"><strong>Africa-Press &#8211; Malawi. <\/strong><\/span>Blantyre business mogul Abdul Karim Batatawala and his son-in-law Shabir Jussab are entangled in a bitter feud that has entered the Midima Magistrates Court in Blantyre.<\/p>\n<p>At the center of the feud is a 2019 Toyota Fortuner registration number BX4246 which Batatawala, through his company, Lido Electrical, claims he borrowed his daughter Alisha to use the car while she was married to Shabir.<\/p>\n<p>However, we have established through court documents, that Jussab, through his company RR Trading, already paid for the vehicle in full as evidenced by a change of ownership letter to the road traffic directorate where Batatatawala indicates that the car was sold to Jussab.<\/p>\n<p>In summons filed through his lawyers Mbeta &amp; Company on 26 October, Batatawala claims that he allowed Jussab to transfer ownership of the vehicle to his name in August 2020 as it was difficult to get a Certificate of Fitness and Insurance for the vehicle while it was registered in Batatawala\u2019s name.<\/p>\n<p>\u201cThe said Mohammed Shabir Salim Jussab and Alisha Mohammed Shabir Jussab are now divorced, as such the motor vehicle cannot continue being in the name of Jussab,\u201d Batatawala\u2019s summons read.<\/p>\n<p>In presenting his defence through his lawyers Clarkes Attorneys, Jussab argues that he bought the vehicle from Batatawala and registered it in his business name after all payments were done.<\/p>\n<p>\u201cThe change of ownership was done for no other purpose than to reflect the legal status of the vehicle after we finished paying for it,\u201d his defence reads.<\/p>\n<p>In a counterclaim, Jussab contends that, while he was out of the country, Batatawala unlawfully took the vehicle and refused to hand it back despite several efforts.<\/p>\n<p>As evidence, Jussab presents six payment vouchers of amounts ranging from K5.2 million to K23 million and totaling K60 million that he made for the purchase of the vehicle from August 2020 to January 2021.<\/p>\n<p>The pair are currently entangled in a different legal battle where the Batatawala wants Jussab arrested for allegedly insulting him via Facebook and WhatsApp.<\/p>\n<p>Jussab, who is currently in Saudi Arabia for personal business, faces allegations of cyber harassment against Batatawala, a prominent businessman with a controversial reputation.<\/p>\n<p>Beatrice Mikuwa, the spokesperson for the South West Region Police, stated that Malawi Police have initiated an Interpol alert to apprehend Jussab and bring him back to Malawi. The allegations against Jussab involve violations of section 86(b) of the Electronic Transaction and Cyber Security Act.<\/p>\n<p>The police assert that between July and August 2023, Jussab employed his computer system to disseminate threatening messages, directed at causing harm to Batatawala and his family.<\/p>\n<p>Jussab, who is estranged from Batatawala\u2019s daughter, is currently situated in Saudi Arabia alongside his son. Additional charges claim that Jussab, 32, also used WhatsApp messages during the same period to intentionally disrupt or attempt to disrupt the peace, privacy, or tranquility of Batatawala and his family members.<\/p>\n<p>The warrant reads, \u201cYou are hereby directed to arrest the said Shabir Jussab and to produce him before this court in execution of this your warrant and herein fail not.\u201d<\/p>\n<p>According to police sources, Jussab allegedly sent offensive and threatening messages to Batatawala, including baseless and sensitive accusations against him and his family.<\/p>\n<p>Batatawala asserted that Jussab committed a cybercrime against him and his family, citing an investigation by the cybercrime unit at Area 30 that traced the messages to Jussab.<\/p>\n<p>In response, Jussab, speaking from Saudi Arabia, claimed that Batatawala\u2019s animosity stems from his refusal to involve his business in supplying goods to the government. Jussab claimed that although he is a British citizen, he declined Batatawala\u2019s repeated requests to use his business for government supply contracts.<\/p>\n<p>\u201cThis is a familial matter. Over the past three years, he has persistently pressured me, even involving his wife and my wife. However, I consistently declined his requests until a few weeks ago. When I refused again, he resorted to threats. I maintain an ethical business that does not involve government dealings,\u201d Jussab clarified.<\/p>\n<p>Jussab further elaborated that despite his British citizenship, his life and livelihood are in Malawi. Yet, due to the ongoing threats, he currently deems it unsafe to return.<\/p>\n<p>Regarding the alleged threatening messages, Jussab stated that he merely forwarded messages circulating against Batatawala, disavowing any active involvement in sending threats. He also dismissed the notion that he had the resources to challenge Batatawala\u2019s wealth-driven legal pursuits.<\/p>\n<p>Notably, Abdul Karim Batatawala has been embroiled in various legal issues, including corruption and money laundering charges. An investigative report by the Platform for Investigative Journalism (PIJ) detailed how Batatawala allegedly engaged in questionable practices involving Malawi\u2019s Defense Force, Police, and Immigration Department.<\/p>\n<p>The report outlined instances where Batatawala\u2019s companies received contracts and payments for goods that were substandard or not delivered as specified.<\/p>\n<p>The investigation also highlighted his manipulation of political connections to secure payments for rejected procurements.
