C\u2019\u00e9tait sous la roulette de Me Alifa Habib Kon\u00e9 du cabinet Dofini-Consult.<\/b><\/p>\n<p>Poursuivis pour assassinat et p\u00e9dophilie, Georges Keita et Yacouba Mounkoro ont \u00e9t\u00e9 plac\u00e9s sous mandat de d\u00e9p\u00f4t depuis 2013 \u00e0 la Maison centrale d\u2019arr\u00eat. Selon l\u2019avocat Me Alifa Kon\u00e9 qui a conduit toute la proc\u00e9dure, la dur\u00e9e d\u2019un mandat de d\u00e9p\u00f4t ne peut exc\u00e9der 1 an en mati\u00e8re criminelle. Elle est renouvelable 2 fois. Si la d\u00e9tention provisoire est n\u00e9cessaire, le mandat est renouvel\u00e9 8 jours avant. Soit en tout 3 ans.<\/p>\n<p><b>\u00ab Dans le cas \u00e9ch\u00e9ant, les juges ont oubli\u00e9 de renouveler le mandat de d\u00e9p\u00f4t en 2014, 1 an apr\u00e8s. Alors, comme l\u2019a pr\u00e9vu la loi, le d\u00e9tenu saisit le r\u00e9gisseur de la prison qui le conduit devant le juge qui \u00e0 son tour, d\u00e9cerne une ordonnance pour sa mise en libert\u00e9. Le d\u00e9tenu rentre chez lui \u00bb,<\/b><\/p>\n<p>a expliqu\u00e9 Me Kon\u00e9. Mes clients ont fait exactement comme l\u2019a pr\u00e9vu la loi. L\u2019un des juges, dit-il, s\u2019est ex\u00e9cut\u00e9 comme l\u2019a pr\u00e9vu la loi, mais le procureur a recherch\u00e9 notre client et l\u2019a mis de nouveau sous mandat de d\u00e9p\u00f4t. L\u2019autre juge a carr\u00e9ment refus\u00e9.<\/p>\n<p><b>\u00ab C\u2019est ainsi que mes deux clients sont rest\u00e9s en prison de 2013 en 2019 soit 6 ans pour comparaitre devant la cour d\u2019assises. Ils ont \u00e9t\u00e9 jug\u00e9s non coupables et acquitt\u00e9s \u00bb,<\/b><\/p>\n<p>a racont\u00e9 l\u2019avocat. Apr\u00e8s leur acquittement, Me Kon\u00e9 a cherch\u00e9 des d\u00e9dommagements pour ses clients pour d\u00e9tention ill\u00e9gale devant le tribunal de la Commune IV. Le tribunal a refus\u00e9 le d\u00e9dommagement.<\/p>\n<p>Suite \u00e0 ce refus, Me Alifa a saisi la Cour de la Justice de la C\u00e9d\u00e9ao. C\u2019\u00e9tait en 2019. Deux apr\u00e8s, la Cour vient de condamner l\u2019Etat malien \u00e0 payer 25 millions \u00e0 chacun des anciens d\u00e9tenus soit 50 millions et a qualifi\u00e9 ladite d\u00e9tention de \u00ab d\u00e9tention arbitraire \u00bb. Chose qui est ill\u00e9gale.<\/p>\n<p>C\u2019est une premi\u00e8re au Mali selon notre interlocuteur. Et cette proc\u00e9dure vient de donner une autre jurisprudence qui surement va permettre \u00e0 l\u2019Etat malien d\u2019amener des politiques n\u00e9cessaires \u00e0 diligenter les proc\u00e9dures \u00e0 d\u00e9faut de se voir condamn\u00e9 par la Cour de la C\u00e9d\u00e9ao. Les mandats de d\u00e9p\u00f4t ont un d\u00e9lai l\u00e9gal. Pour l\u2019ex\u00e9cution de la sentence, apr\u00e8s le d\u00e9lai, \u00ab la Cour de la Justice va saisir la conf\u00e9rence des chefs d\u2019Etat qui \u00e0 son tour interpellera le Mali.
