Africa-Press – Mauritius. <\/strong><\/span>Sony PlayStation is being sued for \u00a35bn in the UK over allegations it \u201cripped off its customers\u201d with overpriced games and in-game purchases. The group legal action, led by consumer rights champion Alex Neill, could see almost nine million gamers compensated.<\/p>\n

It claims Sony PlayStation breached competition law, imposing unfair terms and conditions on games\u2019 developers and publishers, and driving up prices. \u201cThe game is up,\u201d said Ms Neill. Sony PlayStation has yet to comment.<\/p>\n

The claim, filed at the Competition Appeal Tribunal, alleges the gaming company abused its position as the market leader to impose terms and conditions on games\u2019 developers and publishers, including a 30% commission on every digital game or in-game purchase made through the online PlayStation Store.<\/p>\n

The legal case claims Sony PlayStation\u2019s actions have driven up prices for consumers, resulting in customers being \u201cunwittingly overcharged\u201d for digital gaming purchases by up to a total of \u00a35bn over the past six years.<\/p>\n

The estimated damages per individual in the claim is said to be between \u00a367 and \u00a3562. It applies to any customer who has purchased digital games or add-on content on their console or through the PlayStation Store since August 2016.<\/p>\n

\u2018Strong case\u2019<\/p>\n

\u201cWe believe we\u2019ve got a really strong case, or else we wouldn\u2019t be doing this,\u201d Ms Neill told BBC News.<\/p>\n

\u201cIt is a big undertaking to take on a company like Sony.
\n\u201cWith this legal action, I am standing up for the millions of UK people who have been unwittingly overcharged,\u201d she said.<\/p>\n

\u201cWe believe Sony has abused its position and ripped off its customers.<\/p>\n

\u201cThe actions of Sony are costing millions of people who can\u2019t afford it, particularly when we\u2019re in the midst of a cost-of-living crisis and the consumer purse is being squeezed like never before.<\/p>\n

\u201d It is not the first time that concerns have been raised over commission on digital platforms and accessing content. Similar actions have been brought in other countries against Apple and Google.<\/p>\n

\u201cOnce you are in those Apple or Android operating systems, you\u2019re left with no choice but to pay the high costs for content because there is no alternative.<\/p>\n

We say it\u2019s pretty much the same for Sony PlayStation customers,\u201d Ms Neill told BBC News. PlayStation users will automatically have a claim if they: \u2013 Owned a console since 19 August 2016<\/p>\n

\u2013 Live in the UK<\/p>\n

\u2013 Purchased digital PlayStation games<\/p>\n

\u2013 Made in-game purchases via the PlayStation Store<\/p>\n

But Ms Neill warned that cases of this nature can take several years to resolve and that people who might be eligible for compensation could be left waiting if Sony PlayStation refuses to settle the claim.<\/p>\n

\u201cWe would expect, given the number of consumers affected and the amount we believe they have overcharged by, that Sony would want to bring this forward and settle.<\/p>\n

\u201cBut we have no idea what they are planning to do,\u201d she told the BBC. Sony PlayStation did not immediately respond to the BBC\u2019s request for a comment.<\/p>\n
