Africa-Press – Mauritius. <\/strong><\/span>The constitutional complaint filed by former opposition whip Shakeel Mohamed against Soroojdev Phokeer, the Speaker of the National Assembly, was appealed to the Supreme Court yesterday.<\/p>\n

Shakeel Mohamed challenges the decision of the speaker to suspend him from the work of the National Assembly for four sessions from November 11, 2020.<\/p>\n

During this hearing before judges Karuna Devi Gunesh-Balaghee and Patrick Kam Sing, the speaker encountered two objections from Shakeel Mohamed. Through his lawyer, Mr.<\/p>\n

Ravind Chetty, Senior Counsel, the speaker demanded that certain paragraphs of the former opposition Whip’s constitutional complaint be struck out. For the announcer, these paragraphs refer to vexatious comments about him and are irrelevant.<\/p>\n

Sooroojdev Phokeer believes that Shakeel Mohamed’s constitutional complaint does not constitute an arguable case and is contrary to the regulations of the Legislative Assembly.<\/p>\n

Mr. Rajesh Unnuth, assisted by Mr. Hiren Jankee, solicitor, who represents Shakeel Mohamed, objected to the speaker’s two motions. The judges have asked the lawyers to file their closing arguments before the end of February.<\/p>\n

The hearings on Mohamed’s constitutional complaint will take place on March 13. The Attorney General was declared a stakeholder in this contest between Shakeel Mohamed and the announcer.<\/p>\n

He is represented by Me Mooneswur Seetaram, Acting Senior Assistant Parliamentary Counsel. As a reminder, Shakeel Mohamed denounces in his constitutional complaint the actions of the President of the National Assembly.<\/p>\n

He asks the Supreme Court to declare that the announcer violated Articles 1, 3, 12, 16, 31, and 48 of the Constitution. The former Opposition Whip is of the opinion that Sooroojdev Phokeer suspended him for no good reason. He asks the Supreme Court to declare this decision null, illegal and void.<\/p>\n
