Africa-Press – Mauritius. <\/strong><\/span>Getty Images is taking legal action against the makers of an artificial-intelligence image-creation tool. The agency, which sells the rights to use photographers\u2019 and illustrators\u2019 images, said Stability AI\u2019s Stable Diffusion system had infringed these.<\/p>\n

AI image generators \u201clearn\u201d to create images from simple text instructions by analysing human-made pictures, including images found online. Many artists and photographers say they use their work without permission.<\/p>\n

Some artists find image generators a valuable way to express themselves creatively \u2013 but many others worry they can convincingly imitate their style and use it to produce images in seconds.<\/p>\n

\u201cThis thing wants our jobs \u2013 it\u2019s actively anti-artist,\u201d one wrote in a viral tweet.<\/p>\n

\u2018Unlawfully copied\u2019<\/p>\n

Stability AI founder Emad Mostaque has previously told BBC News Stable Diffusion is trained using a compressed file of \u201c100,000GB of images\u201d scraped from the internet.<\/p>\n

He has also talked of working on tools to enable artists and creators to opt out. These included material sourced from Getty Images, researchers have previously found.<\/p>\n

Now the agency says it has begun legal proceedings in the High Court, in London. \u201cStability AI unlawfully copied and processed millions of images protected by copyright.
\n. to the detriment of the content creators\u201d and \u201cchose to ignore viable licensing options and long\u2010standing legal protections\u201d, Getty alleges.<\/p>\n

Chief executive Craig Peters told BBC News Stability AI\u2019s use of work on Getty Images was not \u201csupported by the law and we believe content owners should have a say in how their work is used\u201d.<\/p>\n

\u201cThis is not a statement against generative models,\u201d he said.<\/p>\n

\u201cInstead, we believe it is a responsible and legal path to produce such models.<\/p>\n

\u201d Being scraped<\/p>\n

A Stability AI representative told BBC News it took these matters seriously but said: \u201cIt is unusual that we have been informed about this intended legal action via the press. We are still awaiting the service of any documents. Should we receive them, we will comment appropriately. \u201d<\/p>\n

Picsel, a collection agency that works to ensure creators are paid fairly when their work is copied, has previously warned of the risks to photographers\u2019 and photo agencies\u2019 livelihoods.<\/p>\n

\u201cImagine a photo-agency website being scraped for content to produce AI-derived images which are then sold in competition to that agency\u2019s content,\u201d chief executive Paul Seheult told BBC News in September. Three artists are also bringing a class-action case against Stability AI, and two other defendants, in California.<\/p>\n

Stable Diffusion is \u201cmerely a complex collage tool\u201d, they allege, trained using \u201ccountless copyrighted images\u201d and they are trying to protect artists from \u201cthis blatant and enormous infringement of their rights, before their professions are eliminated by a computer program powered entirely by their hard work\u201d.<\/p>\n

But a Stability AI representative told BBC News: \u201cAnyone that believes that this isn\u2019t fair use does not understand the technology and misunderstands the law.<\/p>\n

\u201d The cases will be watched closely by lawyers with an interest in AI.<\/p>\n

Patrick Goold, a reader in law at City, University of London, said of the US case: \u201cFor hundreds of years, human artists learned by copying the art of their predecessors.<\/p>\n

Furthermore, at no point in history has the law sanctioned artists for copying merely an artistic style. \u201cThe question before the US courts today is whether to abandon these long-held principles in relation to AI-generated images\u201d.<\/p>\n
