Africa-Press – Mauritius. <\/strong><\/span>Intellectual property owners will have greater protections in the African nation after it became the 157th contracting state to two international patent and trademark agreements.<\/p>\n

As of this month, international patents will be protected in Mauritius, following the country\u2019s accession to the Patent Cooperation Treaty (PCT), with the system scheduled to come into effect from 15 March 2023.<\/p>\n

The PCT was introduced in 1970, and protects the patents filed by parties in contracting states across the world, as it allows innovators to file a single patent application which applies to all acceding nations. Mauritius has become the 157th contracting state.<\/p>\n

Patent applicants previously had certain aspects under the PCT recognised by the Mauritian Industrial Property Act 2019, which entered force on 31 January 2022, and allowed the recognition of international applications via the PCT system.<\/p>\n

However, Mauritius will now become a contracting party to the PCT after it deposited its instrument of accession on 15 December 2022. On 6 February, Mauritius joined the Madrid Protocol, opening the doors for trademark owners to file one trademark application across 114 member states which cover 130 nations within the Madrid System.<\/p>\n

The accession to the protocol will remove the requirement for national innovators to file separate applications for each country in which they want to protect their intellectual property.<\/p>\n

On implementation in May this year, the Madrid System will be accessible for Mauritius nationals, or businesses based in the country. The process will require parties to file an application in Mauritius first, from which an international trademark registration would be created.<\/p>\n

The accession will also benefit foreign trademark owners, who will receive the option of designating Mauritius upon filing a new application. Trademark applicants under the system also have the option of designating the Benelux, African Intellectual Property Organisation and the European Union, alongside individual countries.<\/p>\n
