{"id":15553,"date":"2022-03-09T16:57:42","date_gmt":"2022-03-09T16:57:42","guid":{"rendered":"https:\/\/www.africa-press.net\/mozambique\/?p=15553"},"modified":"2022-03-09T16:32:56","modified_gmt":"2022-03-09T16:32:56","slug":"hidden-debts-defence-lawyer-claims-the-public-prosecutors-office-has-been-captured-aim-report","status":"publish","type":"post","link":"https:\/\/www.africa-press.net\/mozambique\/all-news\/hidden-debts-defence-lawyer-claims-the-public-prosecutors-office-has-been-captured-aim-report","title":{"rendered":"Hidden debts: Defence lawyer claims the Public Prosecutor\u2019s Office has been captured \u2013 AIM report"},"content":{"rendered":"<p><span style=\"color: #ff6600\"><strong>Africa-Press &#8211; Mozambique. <\/strong><\/span>The Mozambican Attorney-General\u2019s Office (PGR) \u201chas been captured and politicised\u201d declared Isalcio Mahanjane, one of the defence lawyers in Mozambique\u2019s \u201chidden debts\u201d trial.<\/p>\n<p>Mahanjane represents Antonio Carlos do Rosario, the former head of economic intelligence in the Mozambican security service (SISE), Ndambi Guebuza, the oldest son of former President Armando Guebuza, Ines Moiane, formerly Guebuza\u2019s private secretary, and her nephew Elias Moiane. All face charges of financial offences, such as embezzlement and money laundering.<\/p>\n<p>Speaking on Tuesday at the second day of the summing up by defence lawyers, Mahanjane accused the PGR of working for Mozambique\u2019s enemies. \u201cThis trial has come under enormous political influence\u201d, he claimed, and even went so far as to compare the PGR with the PIDE, the Portuguese political police under colonial rule.<\/p>\n<p>He compared Deputy Attorney-General Alberto Paulo, who interrogated the suspects during the initial investigations, with the notoriously brutal PIDE torturer, Chico Feio.<\/p>\n<p>\u201cWhat is the agenda of this PGR?\u201d, he asked, suggesting that it was working for the western donors, who cut off aid to Mozambique in the wake of the revelations in April 2016 about the true scale of the country\u2019s foreign debts.<\/p>\n<p>Like Rosario, he claimed that he company Kroll, hired to audit the three fraudulent companies Proindicus, Ematum (Mozambique Tuna Company) and MAM (Mozambique Asset Management) was just a nest of western spies.<\/p>\n<p>He cited approvingly an email message from Rosario of June 2017, in which he boasted of throwing the Kroll auditors out of his office. \u201cI am pleased at how they are attacking me\u201d, Rosario wrote at the time.<\/p>\n<p>Mahanjane claimed it was no coincidence that the first islamist terrorist attacks in the northern province of Cabo Delgado, in October 2017, followed shortly after publication of the Kroll audit report. He suggested that the PGR was somehow in league with the terrorists.<\/p>\n<p>\u201cThe PGR wants to destroy this country of heroes\u201d, Mahanjane declared. In particular, the PGR\u2019s targets were SISE, the ruling Frelimo party, and the legal profession, all of which it wanted to wipe out.<\/p>\n<p>He claimed that the detentions of Rosario and of Ndambi Guebuza were \u201cillegal and political\u201d, and the continued detention of Ndambi violated the Mozambican constitution.<\/p>\n<p>He claimed that Ndambi Guebuza\u2019s sole crime is to be the son of the former President, whose enemies were working \u201cto erase the name of Guebuza\u201d from Mozambican history.<\/p>\n<p>He denied the prosecution claim that Ndambi had taken bribes of 33 million dollars from the Abu Dhabi based group, Privinvest. The true figure, said Mahanjane, was \u201conly\u201d ten million dollars.<\/p>\n<p>The money was not a bribe, since Guebuza Junior claimed he had a contract with Privinvest official Jean Boustani. \u201cIs there any law against this?\u201d, asked Mahanjane.<\/p>\n<p>During his testimony last year, Ndambi Guebuza had claimed to be in a business partnership with Boustani but refused to give the court any details of this business.<\/p>\n<p>Constantino Jemusse, lawyer for Renato Matusse, once Guebuza\u2019s political adviser, claimed that his client\u2019s testimony was illegal because it was filmed, despite Matusse\u2019s request to keep the cameras out. This was one of several attempts in the early stages of the trial to muzzle the media. Judge Efigenio Bapista, however, ruled that the entire trial could be broadcast live.<\/p>\n<p>Jemusse accused Baptista of bias in favour of the prosecution, and said he was \u201csubservient\u201d to prosecuting attorney, Sheila Marrengula. There was a \u201cpromiscuous\u201d relation between the court and the Public Prosecutor\u2019s Office, he claimed.<\/p>\n<p>At the close of his speech, he told Baptista \u201cif you don\u2019t acquit my client, you will be passing a sentence of death on the judicial system\u201d.<\/p>\n<p>Baptista took this in his stride, and merely remarked \u201cThese provocations have no effect on me\u201d.<\/p>\n<p>Marrengula will have a chance to reply to the insults by Mahanjane and other defence lawyers when the trial resumes on Thursday.
