{"id":7806,"date":"2021-10-25T17:20:02","date_gmt":"2021-10-25T17:20:02","guid":{"rendered":"https:\/\/www.africa-press.net\/mozambique\/?p=7806"},"modified":"2021-10-25T15:48:12","modified_gmt":"2021-10-25T15:48:12","slug":"bar-association-considers-lawyers-removal-from-trial-illegal-and-abusive-carta-mozambique","status":"publish","type":"post","link":"https:\/\/www.africa-press.net\/mozambique\/all-news\/bar-association-considers-lawyers-removal-from-trial-illegal-and-abusive-carta-mozambique","title":{"rendered":"Bar Association considers lawyer\u2019s removal from trial \u201cillegal and abusive\u201d \u2013  Carta  | Mozambique"},"content":{"rendered":"<p><span style=\"color: #ff6600\"><strong>Africa-Press &#8211; Mozambique. <\/strong><\/span>The removal of lawyer Alexandre Chivale from the \u2018hidden debts\u2019 trial \u2013 taking place since August 23 at the 6th Criminal Section of the Judicial Court of Maputo City \u2013 remains a bone of contention.<\/p>\n<p>Last Friday, the Mozambican Bar Association (AOM), the organization that regulates the profession in the country, issued a note repudiating the decision taken by Judge Efig\u00e9nio Baptista to remove Alexandre Chivale from case n\u00b0 18\/2019- C for allegedly being a member of the State Information and Security Service (SISE) and manager of an alleged vehicle of that institution.<\/p>\n<p>According to the Bar Association, the procedure used by the Court to remove Chivale from the trial at the \u2018B.O tent\u2019 is \u201cillegal, abusive, disrespectful, discrediting and without any use for the good administration of justice, and constitutes an affront to the democratic rule of law and the realization of justice\u201d.<\/p>\n<p>\u201cThe Bar Association, through the National Council, has the exclusive competence to verify the incompatibilities and impediments of its members, as well as, through the Jurisdictional Council, the reserve of exclusive disciplinary jurisdiction for any violation of the duty of probity,\u201d reads the statement published on Sunday. \u201cThe declaration of the impediment of illustrious colleague Dr Alexandre Chivale, under the terms in which it was made, consubstantiates a manifest and serious precedent of usurpation of the Bar Association\u2019s attributions, by another pillar of the administration of justice.\u201d<\/p>\n<p>\u201cIt is the understanding of the National Council of the Mozambican Bar Asis recognised as a reserve of jurisdiction to find the impediments, incompatibilities and the disciplinary infractions of its members provided for in its Statute,\u201d the statement adds, emphasizing that the interpretation of the regime regarding incompatibilities and impediments provided for in the statute of the order \u201cdoes not allow, in abstract, a generalisation of the impediment to any lawyer who is linked to a public institution public of sponsoring litigation against the state\u201d.<\/p>\n<p>The Bar Association note was issued one day after the organization, as Assistant to the Public Prosecutor\u2019s Office in Claims No. 18\/2019-C, unsuccessfully asked judge Efig\u00e9nio Jos\u00e9 Baptista to review his decision, as was the competence of the organization\u2019s National Council.<\/p>\n<p>\u201cAttorney Alexandre Chivale was not removed just because he is a public official, but also because there are conflicts of interest and evidence of crimes. It is not abosociation that, if the courts are competent to find the procedural impediments, the Mozambican Bar Association, as an entity with powers of self-regulation of the profession, ut any persecution,\u201d Baptista told the Mozambican Bar Association representatives, adding that the court could not reverse its decisions, and that they would therefore have to appeal to a higher court.<\/p>\n<p>The judge also explained that the court must decide in the case files, as it is in the case files that any type of impediment is declared, including the judge\u2019s own. \u201cThe court is not able to understand how a different entity can decide an issue outside the case files, and [it] then be added to the case files,\u201d Judge Batista concluded.<\/p>\n<p>Following the removal of Alexandre Chivale, Isalcio Mahanjane is the new judicial representative of Ant\u00f3nio Carlos Do Ros\u00e1rio, Maria In\u00eas Moiane and Elias Moiane.
