{"id":9318,"date":"2021-11-22T16:40:44","date_gmt":"2021-11-22T16:40:44","guid":{"rendered":"https:\/\/www.africa-press.net\/mozambique\/?p=9318"},"modified":"2021-11-22T16:18:02","modified_gmt":"2021-11-22T16:18:02","slug":"mozambique-lawyers-want-the-same-immunity-as-mps","status":"publish","type":"post","link":"https:\/\/www.africa-press.net\/mozambique\/all-news\/mozambique-lawyers-want-the-same-immunity-as-mps","title":{"rendered":"Mozambique: Lawyers want the same immunity as MPs"},"content":{"rendered":"<p><span style=\"color: #ff6600\"><strong>Africa-Press &#8211; Mozambique. <\/strong><\/span>The former vice-president of the Mozambican Bar Association (OAM) Jos\u00e9 Caldeira on Friday argued that lawyers should enjoy the same immunities as MPs, aiming at the full exercise of the function and defence of the democratic rule of law.<\/p>\n<p>\u201cMPs speak freely and accuse their peers [of various facts] and cannot be criminally prosecuted for those facts, it is not the same that is happening with lawyers,\u201d Caldeira said.<\/p>\n<p>Caldeira, a former judge, was speaking at a round table on \u201cDefence and Strengthening of Lawyers\u2019 Prerogatives\u201d, organised on Friday in Maputo by the OAM.<\/p>\n<p>The attribution in the law of immunities would protect lawyers from being the target of criminal proceedings for acts and statements made in the exercise of the right to defend defendants.<\/p>\n<p>This is, he said, a prerogative in favour of defenders and, above all, of citizens who need legal assistance.<\/p>\n<p>Caldeira said that the curtailment of lawyers\u2019 freedom of movement in police stations was one of the main threats to the right to defence.<\/p>\n<p>\u201cUnfortunately, we still have situations in which the full exercise of the practice of law is impeded because the authorities do not understand or do not want to accept the importance of the lawyer, in private, having his client [in private], but also having professional secrecy,\u201d he said.<\/p>\n<p>He said it was common for police officers to refuse to allow lawyers and their clients to confer in private, in police stations, undermining the duty of professional secrecy imposed on lawyers.<\/p>\n<p>The president of the OAM\u2019s Commission for the Strengthening of Lawyers\u2019 Prerogatives (CRPA), Andr\u00e9 J\u00fanior, also defended the strengthening of protection for lawyers so that they can fully exercise their function.<\/p>\n<p>\u201cLawyers are sanctioned just for expressing opinions inherent to the exercise of their function, leaving them in a situation of fragility, when they are only performing an activity with constitutional dignity,\u201d said J\u00fanior.<\/p>\n<p>Police stations are the places where lawyers are exposed to situations of greater vulnerability because their presence is confused with complicity with suspects in the commission of crimes.<\/p>\n<p>\u201cThe lawyer\u2019s function should not be seen as confined to court because the lawyer should intervene in all stages of the criminal process,\u201d he said.<\/p>\n<p><a href=\"\/\/www.facebook.com\/ordemdosadvogadosdemocambique\/posts\/4477567705692467\"><b>Facebook Post click here<\/b><\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Africa-Press &#8211; Mozambique.
