{"id":13010,"date":"2022-02-23T17:12:42","date_gmt":"2022-02-23T17:12:42","guid":{"rendered":"https:\/\/www.africa-press.net\/namibia\/all-news\/spyl-questioned-over-shanghala-prison-notes"},"modified":"2022-02-23T17:27:31","modified_gmt":"2022-02-23T17:27:31","slug":"spyl-questioned-over-shanghala-prison-notes","status":"publish","type":"post","link":"https:\/\/www.africa-press.net\/namibia\/all-news\/spyl-questioned-over-shanghala-prison-notes","title":{"rendered":"SPYL questioned over &#8216;Shanghala prison notes&#8217;"},"content":{"rendered":"<p><span style=\"color: #ff6600\"><strong>Africa-Press &#8211; Namibia. <\/strong><\/span>TILENI MONGUDHI and ELIASER NDEYANALE<\/p>\n<p>THE Anti-Corruption Commission (ACC) has questioned the Swapo Party Youth League (SPYL) over a letter allegedly written by former justice minister Sacky Shanghala calling for anti-American protests.<\/p>\n<p>Last year, the United States imposed sanctions on fisheries minister Bernhard Esau and Shanghala for their role in the N$3 billion Fishrot scandal.<\/p>\n<p>Esau&#8217;s family is also banned from entering the US.<\/p>\n<p>Now the ACC is claiming that Shanghala wanted to use the SPYL to divert attention from his corruption court case.<\/p>\n<p>Senior counsel Vas Soni, who is representing Shanghala in his bail hearing taking place in the Windhoek High Court, on Monday questioned ACC investigator Andreas Kanyangela about the allegation that Shanghala tried to instigate a public protest.<\/p>\n<p>Soni told Kanyangela that according to his instructions, a person who assists one of Shanghala&#8217;s co-accused, Tamson Hatuikulipi, in his business, was going to do some form of political protest, which Shanghala advised against.<\/p>\n<p>\u201cThat was all of Shanghala&#8217;s involvement,\u201d Soni said, adding that if Kanyangela and other investigators tried to get Shanghala&#8217;s version in response to those allegations, that is what they would have found out.<\/p>\n<p>However, Kanyangela also alleged that Shanghala was involved in a failed attempt to bribe members of the Affirmative Repositioning movement to participate in a protest.<\/p>\n<p>\u201cThe initiative came from Mr Shanghala,\u201d Kanyangela said.<\/p>\n<p>The Namibian obtained notes allegedly written by Shanghala in July 2021, after the arrest of SPYL leader Sylas Tangi Mungoba for allegedly attempting to bribe AR leaders into organising a march in support of Shanghala and Esau against the US government.<\/p>\n<p>The notes could not be authenticated at the time. They, however, reveal that the author was fuming over the US sanctions. In the notes, the writer attempted to get the SPYL to butt heads with the American government.<\/p>\n<p>The handwritten notes attempted to garner support from the SPYL as a counterweight to the US government&#8217;s travel ban.<\/p>\n<p>In them, the writer pleaded with the SPYL not to allow the American government, which he described as having a tainted past, to interfere in Namibia&#8217;s affairs.<\/p>\n<p>\u201cThe conduct of the US government resembles that of an uncle who binds the arms of a child so that his favourite can punch the other one who is defenceless with tied arms.\u201d<\/p>\n<p>One of the notes was addressed to \u201cSPYL secretary Willem Nekongo\u201d. In the note, Shanghala allegedly requested that Nekongo engage Swapo deployees in government to ask them why they were comfortable allowing a foreign government \u201cpreviously of the likes of Ronald Reagan who were opposed to Swapo and Namibia&#8217;s independence\u201d, to cast aspersions.<\/p>\n<p>He believed that the American government&#8217;s actions, to blacklist the two ministers, will further the cause of anti-Swapo cabals who \u201chave slipped into important government positions, and influence the courts and society on the matter which is sub judice\u201d.<\/p>\n<p>\u201cThe USA ought to be questioning why our comrades are serving prison sentences even before conviction. Instead, they are insulting the intelligence of all human rights minded Namibians to insinuate that there are sinister moves to release the comrades,\u201d read the notes.<\/p>\n<p>The author continued to motivate why he should be granted bail, saying that there is nothing sinister about the release of someone to afford them a chance to prepare for trial and defend themselves.<\/p>\n<p>They called upon the SPYL to speak up to avoid creating a precedent of interference, and added that he and his co-accused understood that comrades who wine and dine American diplomats may find it difficult to question that government&#8217;s actions.<\/p>\n<p>\u201cUncle Sam (personification of the USA government) must learn to recognise its dark history before it starts wrecking our peace and tranquility. Uncle Sam&#8217;s appetite for regime confusions will soon morph into something sinister and our elders ought to be reminded if they have forgotten.\u201d<\/p>\n<p>\u201cTherefore comrade secretary, please take action,\u201d Shanghala allegedly said.<\/p>\n<p>The first note was addressed to a \u201cTangi Mungoba\u201d, believed to be SPYL leader Sylas Tangi Mungoba, who was last year arrested on alleged bribery charges for allegedly attempting to bribe Affirmative Repositioning leaders into organising a march calling for the release of the Fishrot accused.<\/p>\n<p>He was released on N$10 000 bail.<\/p>\n<p>In the note, Mungoba was asked to plant the seed within the SPYL&#8217;s structures.<\/p>\n<p>\u201cThe idea is that your structure corresponds to the SPYL secretary. That way, it is not an act of speaking on behalf of the SPYL, rather, it is the SPYL speaking among its membership.\u201d<\/p>\n<p>Mungoba is a member of the SPYL&#8217;s Khomas regional executive.<\/p>\n<p>The instruction also points to Mungoba using article 10 (i)(C) and (f) of the Swapo constitution to justify initiating the discussion.<\/p>\n<p>\u201cOnce you share it on your platform, who can keep it from other platforms?\u201d<\/p>\n<p>The second note was addressed to \u201cWillem Nekongo\u201d SPYL secretary. The subject of this note was \u201cthe issue of the US state department&#8217;s designation of comrades Esau and Shanghala as persona non grata&#8221;.<\/p>\n<p>The letter urges the SPYL to oppose the 15 June 2021 US government pronouncement that placed Shanghala and Esau under travelling sanctions, after he was approached by a number of his comrades who expressed shock and anger at the American government&#8217;s treatment of Shanghala and Esau.<\/p>\n<p>\u201cHow can the comrades ever receive a fair trial if the US government by its conduct, without it having tried the comrades in a fair trial, have already convicted the comrades?\u201d<\/p>\n<p>The note further asserted that the concerns about the American government&#8217;s involvement in the Fishrot matter stem from the fact that the US embassy (in Namibia) facilitates training programmes for the Namibian criminal justice cluster.<\/p>\n<p>These include the prosecutor general&#8217;s office, the Namibian Police, the Financial Intelligence Centre, the ACC, the Ministry of Justice and the Judiciary.<\/p>\n<p>\u201cAre we to assume that the US government will not use its position of benefactor to seek to obtain a preordained outcome in respect of the case before the court?\u201d<\/p>\n<p>SPYL secretary Ephraim Nekongo told The Namibian yesterday claimed that the letter is a fabrication.<\/p>\n<p>\u201cAs far as I know, Shanghala is somebody who knows me personally, he knows who I am as a secretary of the SPYL and he will never make an error like that, to make me Willem Nekongo,\u201d Nekongo said.<\/p>\n<p>The ACC questioned him about the letter last year and a statement was taken from him on the matter, he said.<\/p>\n<p>He was also queried about SPYL&#8217;s plan to stage the demonstration in relation to the detention of Shanghala and other Fishrot accused.<\/p>\n<p>\u201cThat was the first time I saw that letter. I have never received it. As far as I am concerned, I did not receive it and I am the only secretary of the SPYL. That letter was not addressed to us. When I also looked at it, it looked like something that was fabricated because how can Sacky, who knows me, refer to me as Willem Nekongo? When you go into details, you can see that it [the letter] does not hold water at all.<\/p>\n<p>\u201cThere is no Willem Nekongo.
