{"id":23221,"date":"2022-06-25T15:13:50","date_gmt":"2022-06-25T15:13:50","guid":{"rendered":"https:\/\/www.africa-press.net\/namibia\/all-news\/legal-attack-on-govt-medicine-tender-rules"},"modified":"2022-06-25T15:26:42","modified_gmt":"2022-06-25T15:26:42","slug":"legal-attack-on-govt-medicine-tender-rules","status":"publish","type":"post","link":"https:\/\/www.africa-press.net\/namibia\/all-news\/legal-attack-on-govt-medicine-tender-rules","title":{"rendered":"Legal attack on Govt medicine tender rules"},"content":{"rendered":"<p><span style=\"color: #ff6600\"><strong>Africa-Press &#8211; Namibia. <\/strong><\/span><b>A COMPANY that wants to take part in bidding for the supply of medicines to the state health system wants the High Court to remove a tender condition that only medicines registered or authorised in Namibia should be supplied to the government.<\/b><\/p>\n<p>In an urgent application heard in the Windhoek High Court on Wednesday, the company Afripharm Investments is asking the court to declare conditions in a tender for the supply of medicines to the government, and also a requirement of the Namibia Medicines Regulatory Council (NMRC), as unlawful and irrational, and to set these aside.<\/p>\n<p>In terms of those conditions, medicines which bidders in a tender for the supply of pharmaceuticals to the Ministry of Health and Social Services offer to supply to the government must be registered with the NMRC, or be authorised by the council to be supplied in Namibia without being registered.<\/p>\n<p>A director and shareholder of Afripharm Investments, Sara Katiti, claims in an affidavit filed at the court that the tender conditions are \u201chighly unreasonable, unfair, irrational, inhibitive and quite unnecessary\u201d.<\/p>\n<p>Katiti says her company has been supplying pharmaceutical products to the health ministry and wants to submit a bid for the supply of medicines for a period of two years under a tender advertised by the Central Procurement Board of Namibia on 29 April.<\/p>\n<p>The pharmaceutical products which Afri\u00adpharm Investments wants to offer to supply to the government includes medicines used in countries like the United Kingdom, Germany, the Netherlands and Hungary \u2013 but which are not registered in Namibia, according to Katiti.<\/p>\n<p>She claims it is unlawful to require that medicines offered by bidders should be registered or authorised by the NMRC at the stage of the tender process, rather than thereafter, once the procurement board has awarded a tender to a bidder.<\/p>\n<p>She also says it is unreasonable to expect bidders to go through a cumbersome process to get authorisation from the NMRC for pharmaceutical products which a successful bidder would have to supply to the health ministry only once it receives a purchase order for such products.<\/p>\n<p>If that happens, a supplier would have a delivery time of up to 12 weeks to supply the required product, Katiti states.<\/p>\n<p>Lawyer Sisa Namandje, representing Afripharm Investments, argued during the hearing of the case before acting judge Doris Hans-Kaumbi on Wednesday that there was no record of a meeting at which the NMRC decided to require that medicines to be supplied by bidders had to be registered or authorised by the council before the procurement board makes its decision on the tender bids it receives.<\/p>\n<p>The bidding process is closing on 29 June.<\/p>\n<p>Both lawyers, Sakeus Akweenda, representing the procurement board, and Eliaser Nekwaya, who represented the NMRC, argued that the company&#8217;s application did not meet the requirements to be heard as an urgent matter.<\/p>\n<p>Akweenda said the tender was advertised on 29 April and the company collected the tender documents on 3 May, but filed its application against the procurement board, the government, the NMRC and the registrar of medicines only on 14 June.<\/p>\n<p>He argued that Afripharm Investments has to date not applied for permission to sell unregistered medicines as required by law. The company has also failed to disclose which medicines it wishes to supply to the health ministry, he said.<\/p>\n<p>The company says it wants to bid to supply 200 of the 473 pharmaceutical products for which the procurement board has issued a tender.<\/p>\n<p>Nekwaya said the NMRC needed to assess the efficacy of medicine and decide whether to authorise its use in Namibia.<\/p>\n<p>He said it could well be that medicines which Afripharm Investments wants to include in its tender bid are already registered in Namibia, or do not need to be registered.<\/p>\n<p>The tender conditions have a legitimate purpose and are rational, Nekwaya also argued.<\/p>\n<p>Hans-Kaumbi is due to deliver her judgement in the matter today.<\/p>\n<p><strong>For More News And Analysis About <a href=\"https:\/\/www.africa-press.net\/namibia\">Namibia<\/a> Follow <a href=\"https:\/\/www.africa-press.net\/\">Africa-Press<\/a><\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Africa-Press &#8211; Namibia.
