Africa-Press – Namibia. <\/strong><\/span>FOREIGNNESS IS A FORM of otherness based on one’s nationality. It reflects a societal ordering in which citizens (everywhere) are distinguished from non-citizens.<\/p>\n

Governments use this societal ordering to maintain and secure the identity of their citizens. In doing so, they exclude those who are not their citizens.<\/p>\n

All governments everywhere are guilty of this. What constitutes a citizen or non-citizen differs from country to country, yet foreigners and citizens exist in all countries.<\/p>\n

Concerning citizenship, Namibia is unique. Citizenship in Namibia is socially distinguishable between native-natives (predominantly blacks) and foreign-natives (mainly whites).<\/p>\n

The native-natives are people of ethnic African origin. The foreign-natives are people of ethnic non-African origins (primarily descendants of European settlers).<\/p>\n

All people outside this binary are foreigners, popularly called non-Namibians. This is a different form of otherness found in most African countries.<\/p>\n

In Namibia, there is a big discussion about foreign land ownership.<\/p>\n

Affirmative Repositioning (AR) has been calling for the urgent passing of legislation to regulate the right to acquire property by non-Namibians.<\/p>\n

The AR would like the legislature to pass a bill prohibiting land ownership (communal and urban land and commercial farms for any purpose) by non-Namibians.<\/p>\n

They want the government to deem illegal transactions and any allocation of communal land to foreigners before the draft bill is passed.<\/p>\n

They are also clamouring for expropriating urban land already owned by foreign nationals.<\/p>\n

AR: EIGHT TROUBLING ASSUMPTIONS<\/p>\n

There is no country where land or real estate is made freely available to anyone, even citizens.<\/p>\n

I believe, in summary, that the AR is pushing for a scenario where foreigners can only own land by partnering with a Namibian, who will hold 51% of the land.<\/p>\n

However, critically reviewing the AR proposal, eight dangerous assumptions come to mind.<\/p>\n

(1) Namibian citizens (both native-natives and foreign-natives) cannot compete against non-Namibians in the land market.<\/p>\n

The reality is that foreign-natives control the market.<\/p>\n

(2) Non-Namibians lack the creativity necessary for alternative means of ‘owning land’ if banned from land ownership.<\/p>\n

The truth is that property rights evolve, and players in the market evolve with new ideas too.<\/p>\n

(3) Namibians are immobile people who do not travel to other countries and don’t aspire to make their homes in other countries.<\/p>\n

I suppose that if Namibia stops non-Namibians from buying land in Namibia, non-Namibian countries will take retaliatory action. This will squash the dreams of Namibians interested in buying land in foreign countries or making foreign countries their homes.<\/p>\n

(4) If foreigners are stopped from owning land, then native-natives will suddenly have access to land.<\/p>\n

This is unlikely because foreign natives have the financial and social networks to continue to buy valuable land with the intent to deny native-natives access to land.<\/p>\n

(5) Land will not be transferable (an essential property characteristic) from Namibian citizens to non-Namibians after passing the draft bill.<\/p>\n

Again, property rights evolve, and their actors always find a way to beat regulations. Time is usually their only limitation. Sales and purchases are not the only means of transfer. Donations, gifting and inheritance, are other ways. We have seen the government acquire land to lease out to foreign investors.<\/p>\n

(6) Investors would come to Namibia with cash since there is no preference for owning land.<\/p>\n

This will forestall development by mitigating land ownership. It is unlikely that serious investors will come to Namibia without land or real estate property as security.<\/p>\n

(7) There is no other middle ground for ensuring land access for Namibians except through a ban on foreign ownership.<\/p>\n

I see a lack of creativity here because several middle grounds exist, including the introduction of land ceilings and nationalisation, to mention a few.<\/p>\n

(8) Namibia can no longer be home to anyone who is non-Namibian.<\/p>\n

This is a dangerous move because people’s homes should be where they live with their families.<\/p>\n

ANTI-FOREIGN MEANS ANTI-AFRICAN<\/p>\n

Prominent AR spokespersons have always questioned why \u201cland does not belong to us (Namibians)?\u201d<\/p>\n

As a self-proclaimed anti-imperialist and pan-Africanist movement, one would have expected the AR to consider the plight of African non-Namibians in their proposal.<\/p>\n

As far as one can read from the AR proposal, it has no place for African non-Namibians in Namibia.<\/p>\n

Fortunately for Namibia, other African countries invested in its liberation have not banned Namibians from owning land in their countries or put foreign-natives, wherever they are in Africa, before Namibians.<\/p>\n

Current data from the Namibian Statistics Agency (as presented by the AR during their parliamentary hearing) indicates that 27% of land in Namibia is owned by foreign-natives and 14% by the government.<\/p>\n

About 61% of land is owned by churches (with foreign-native links).<\/p>\n

It is also common knowledge that lending (banks) favours foreign-natives (including non-Namibians of European descent) in home loan application approvals.<\/p>\n

Therefore, African foreigners barely own land in Namibia.<\/p>\n

I hope the AR will be brave enough to devise a policy that is not punitive to African non-Namibians.<\/p>\n

My message: Do not ban foreigners, especially African non-Namibians, from buying land in Namibia. Namibia would be extending its inherited list of ‘otherness’ from the apartheid era by prohibiting foreigners from owning land.<\/p>\n
