Africa-Press – Namibia. <\/strong><\/span>AN AUDITING firm’s forensic investigation into the Fishrot fishing quotas fraud and corruption case cost the Anti-Corruption Commission (ACC) more than N$15 million, according to testimony heard in the Windhoek High Court yesterday.<\/p>\n

\u201cYou have shocked even me,\u201d defence lawyer Richard Metcalfe remarked after the cost of auditing firm Deloitte’s probe into financial transactions linked to the Fishrot case was mentioned by ACC investigator Andreas Kanyangela during his testimony in the bail hearing of Tamson ‘Fitty’ Hatuikulipi, who is one of the 10 people charged over alleged fraud and corruption in the use of Namibian fishing quotas.<\/p>\n

Kanyangela mentioned the cost of Deloitte’s investigation while answering questions posed by Metcalfe.<\/p>\n

The auditing firm’s report, in which financial transactions involving the accused in the Fishrot case and fishing companies doing business in Namibia are recorded and analysed, has featured repeatedly during the hearing of bail applications by some of the accused in the matter.<\/p>\n

During his cross-examination of Kanyangela, Metcalfe noted that in a covering letter Deloitte gave the ACC with its report on its investigation, the firm stated that its findings in the report were not conclusive and could change if it was provided more information.<\/p>\n

Metcalfe charged that the ACC has been \u201ccreating a false narrative\u201d about the alleged impact that the relationship of the men charged in the Fishrot case with the Icelandic fishing company group Samherji had on the Namibian fishing sector and employment in the fishing industry.<\/p>\n

In contrast to claims that Samherji’s involvement in the Namibian fishing sector has resulted in job losses, official statistics show an increase in employment in the country’s fishing industry, Metcalfe said.<\/p>\n

If there was an increase in employment figures in the fishing sector that does not mean there was no corruption as well, Kanyangela responded to that statement.<\/p>\n

Metcalfe also questioned Kanyangela about figures quoted in an annual report of the ACC last year. In that report, the commission stated that it had a 55% success rate in cases that resulted in convictions over the previous year, and that it recorded a success rate of 57% in terms of cases resulting in convictions since the ACC started operating in 2006.<\/p>\n

The state seems to be selective in choosing whom to prosecute in the Fishrot case, Metcalfe charged as well.<\/p>\n

Turning to former senior Samherji employee Jo\u0301hannes Stefa\u0301nsson, the whistleblower whose revelations of alleged corruption and fraud involving Samherji played a key role in the ACC’s investigation of the case, Metcalfe commented that from what Stefa\u0301nsson has stated he was \u201cthe head honcho, the number one criminal\u201d who was running Samherji’s operations in Namibia.<\/p>\n

Stefa\u0301nsson was \u201cthe chief architect\u201d of all of the things being alleged against the accused in the case, Metcalfe added.<\/p>\n

During Hatuikulipi’s bail hearing before acting judge David Munsu this week, Kanyangela said according to evidence gathered by the ACC, the accused in the Fishrot case derived financial benefits totalling more than N$317 million from Namibian fishing quotas allocated by Hatuikulipi’s father-in-law, former minister of fisheries and marine resources Bernhard Esau, and utilised by Samherji and other companies.<\/p>\n

According to evidence gathered by the ACC, Hatuikulipi received financial benefits amounting to more than N$75 million from his involvement in a scheme to get access to Namibian fishing quotas, Kanyangela also testified.<\/p>\n

Hatuikulipi, Esau and four other accused in the case \u2013 including former justice minister and attorney general Sacky Shanghala and a cousin of Hatuikulipi, James Hatuikulipi, whom Esau appointed as chairperson of the board of directors of the state-owned National Fishing Corporation of Namibia (Fishcor) \u2013 were arrested near the end of November 2019.<\/p>\n

Hatuikulipi, Esau, Shanghala and James Hatuikulipi have been held in custody since their arrest.<\/p>\n
