{"id":31609,"date":"2022-10-18T18:07:36","date_gmt":"2022-10-18T18:07:36","guid":{"rendered":"https:\/\/www.africa-press.net\/namibia\/all-news\/mps-want-summaries-submitted-with-parliamentary-bills"},"modified":"2022-10-18T18:29:07","modified_gmt":"2022-10-18T18:29:07","slug":"mps-want-summaries-submitted-with-parliamentary-bills","status":"publish","type":"post","link":"https:\/\/www.africa-press.net\/namibia\/all-news\/mps-want-summaries-submitted-with-parliamentary-bills","title":{"rendered":"MPs want summaries submitted  with parliamentary bills"},"content":{"rendered":"<p><span style=\"color: #ff6600\"><strong>Africa-Press &#8211; Namibia. <\/strong><\/span>LAWMAKERS in the National Assembly want all bills that are tabled in parliament be accompanied by summaries, which they said would make it easy to understand and debate the proposed legislation.<\/p>\n<p>LAWMAKERS in the National Assembly want all bills that are tabled in parliament be accompanied by summaries, which they said would make it easy to understand and debate the proposed legislation.<\/p>\n<p>Vipuakuje Muharukua of the Popular Democratic Movement (PDM) and Maureen Hinda-Mbuende of Swapo called for bill summaries for members to understand the logic behind such legislation before they commerce with debates.<\/p>\n<p>Muharukua and Hinda-Mbuende expressed the need for more information following the tabling of a bill on the repeal of obsolete laws\u2013phase 2 by the justice minister, Yvonne Dausab, on Thursday.<\/p>\n<p>Dausab said the Law Reform and Development Commission (LRDC) had initiated phase 2 of the repeal of obsolete laws project.<\/p>\n<p>She added that the commission has identified for repeal an additional 71 discriminatory and outdated legislative pieces, which include amendments to the principle obsolete statutes.<\/p>\n<p>Muharukua argued that members of parliament often have limited time to acquaint themselves with bills, which causes them to debate and pass laws that they often do not understand.<\/p>\n<p>For instance, the opposition member said the LRDC took two years before the bill was submitted to parliament, while parliament would be pressed to debate and pass the bill.<\/p>\n<p>\u201cParliament is then seized with a document that has been worked on over two years, which members have to debate and pass within a specific timeframe,\u201d Muharukua said.<\/p>\n<p>Hinda-Mbuende supported Muharukua&#8217;s submission, saying that bills should come with additional information.<\/p>\n<p>\u201cI support the opinion that there is a need for additional information for one to agree if, for example, I am looking a the Karakul Pelt Export Duty Amendment Ordinance of 1965 that is being repealed as a whole.it would have been nice if one has more information like where the additional provisions are catered for,\u201d said Hinda-Mbuende, who is also the deputy finance minister.<\/p>\n<p>Meanwhile, the PDM chief whip added that parliament lacks research capacity to assist lawmakers in their legislative functions.<\/p>\n<p>\u201cWhat we lack as parliament is the capacity to do research. It is the structural problem that parliament has in terms of legal research because we&#8217;re passing these laws, but if we step out of here (the house) and the media asks why this specific law is being repealed, we will not be able to answer,\u201d said Muharukua.<\/p>\n<p>National Council, executive director Tousy Namiseb, earlier told Desert Radio that parliament does not have enough accountants, auditors and legal drafters.<\/p>\n<p>\u201cParliament has a constitutional mandate which is threefold &#8211; legislative, oversight and representation. The elected members are not necessarily specialists in all these fields, therefore, you have staff members supporting all the members,\u201d Namiseb said.<\/p>\n<p>&#8216;REVISE LEGISLATIVE PROCESS&#8217;<\/p>\n<p>On the other hand, Muharukua called for the revision of the legislative process where members of parliament only get to know about proposed legislation when they are tabled in the house by the members of the executive.<\/p>\n<p>\u201cParliament should be afforded an opportunity to know when we are passing laws. If the government, the state or the Law Reform and Development Commission and the drafters do not inform the parliament, we have nothing. [&#8230;] Perhaps it is also about time we start revisiting our processes. What harm would it bring to our legal drafting process if a member of parliament is privy to a bill that has passed through Cabinet before it is tabled in parliament?\u201d Muharukua asked.<\/p>\n<p>The second phase of the obsolete laws project comes after the promulgation of the Repeal of Obsolete Laws Act of 2018, which repealed and amended 143 proclamations, ordinances and acts.<\/p>\n<p>Acts, ordinances and proclamations to be repealed include the Indecent or Obscene Photographic Matter Act of 1967, the Importation of Cement Ordinance of 1963 and the Promotion of the Density of Population in Designated Areas Act of 1979.<\/p>\n<p>In her motivation, Dausab said it is evident the accumulation of such discriminatory, and in many instances problematic laws, has hampered the nation from moving forward.<\/p>\n<p>\u201cAs a government, we further recognise that public perception is that we are not doing enough to rid our legal landscape of outdated or obsolete laws.<\/p>\n<p>\u201cBut law reform is long and tedious and requires public support and understanding.
