Ekandjo threatened to sue the ruling party if it did not allow him to challenge deputy prime minister Netumbo Nandi-Ndaitwah, prime minister Saara Kuugongelwa-Amadhila, and minister of environment, forestry and tourism Pohamba Shifeta for the Swapo vice presidency position.<\/p>\n

A special Swapo Central Committee meeting sat on Friday to discuss Ekandjo’s plea after he was eliminated during the nomination process last month.<\/p>\n

Ekandjo could not be reached for comment yesterday.<\/p>\n

His lawyer, Richard Metcalfe, said he was waiting for instructions.<\/p>\n

The party meeting, chaired by president Hage Geingob, relied on a legal opinion drafted by secretary Kawana, dated 3 October, to block Ekandjo’s return.<\/p>\n

Kawana said: \u201cComrade Jerry Ekandjo was lawfully and legitimately eliminated during the candidates’ identification process.<\/p>\n

\u201cHe has no right to be presented to the congress as one of the high-scoring members, even when the number of four candidates has since been reduced to three because of a withdrawal.<\/p>\n

\u201cIt has already been pointed out above that he does not have the right to take the position of the candidate who withdrew from the list.<\/p>\n

\u201cThis does not derogate from the fact that the central committee could, if it so wishes, decide to grant such an opportunity if it does not by implication amend the rules or otherwise renders the rules nugatory.\u201d<\/p>\n

Kawana’s legal opinion stated that Ekandjo was not affected by the Helmut amendments, and that he was purely disqualified because he failed to meet the required votes during the nomination and elimination process at the central committee.<\/p>\n

He poured cold water on Ekandjo’s earlier claims that he lost to minister of defence and veterans affairs Frans Kapofi during the process, while Kapofi did not meet the requirements to stand for vice president as per the Helmut amendments.<\/p>\n

Kawana’s opinion said Kapofi and minister of mines and energy Tom Alweendo met the requirements too, because they have been party members for longer than 10 years before the Helmut amendments took effect in 2018.<\/p>\n

Kawana relied on transitional clauses, which states that anyone who was a party member for 10 years before the amendments took effect would be eligible to run for a top-four position.<\/p>\n

These were the requirements before the constitution was changed to incorporate the Helmut amendments.<\/p>\n

During the elimination contest Ekandjo lost to Shifeta and Kapofi who joined Kuugongelwa-Amadhila and incumbent party vice president Netumbo Nandi-Ndaitwah.<\/p>\n

Kapofi, however, pulled out of the race a few days later.<\/p>\n

Kawana’s opinion added that Ekandjo’s initial insistence that Kapofi and Alweendo were nominated unconstitutionally is not valid and therefore his claim of being allowed to run for the vice presidency position could not be hinged on those arguments.<\/p>\n

He said Ekandjo was disqualified from running because he did not score the required votes during the elimination process, and that Kapofi dropping out of the race does not entitle Ekandjo to run in his place.<\/p>\n

He said the central committee has the power to decide whether to allow Ekandjo or Alweendo to run and include them on the list of candidates, but that does not mean it has changed the party rules or its constitution, nor does it mean that future candidates would be entitled to the same treatment.<\/p>\n

Political analysts believe the central committee decision could add to the already existing chaos and division within the ruling party.<\/p>\n

\u201cIt’s not a wise decision nor is it a strategic one,\u201d says Ndumba Kamwanyah.<\/p>\n

Institute for Public Policy Research director Graham Hopwood says Swapo is in danger of creating a legitimacy crisis for itself ahead of the November congress, by creating confusion over which rules it is following.<\/p>\n

He says it seems logical that the next best-placed person, Ekandjo, would be allowed to stand unless there was a rule that disallowed this.<\/p>\n

\u201cAny election needs to be rule-based to ensure its outcome is accepted, and if the party is seen to be acting arbitrarily it could result in a loss of credibility and possible legal disputes,\u201d Hopwood says.<\/p>\n
