Africa-Press – Namibia. <\/strong><\/span>NATIONAL police spokesperson deputy commissioner Kauna Skiwambi last week said 248 civil cases were registered against the police since last year.<\/b><\/p>\n

According to her, the cases range from assault to the illegal detention of members of the public. Shikwambi said 23 out of the 248 cases have been finalised, while five have been submitted for payment by the police, and seven have been closed.<\/p>\n

She said five cases have been withdrawn by complainants, two dismissed by court, two have been struck off the court roll as complainants absconded, and another two have been settled with no payment.<\/p>\n

Shikwambi said 225 cases are still pending, and the police’s legal costs incurred have not been submitted to her office. \u201cHowever, the police normally pay the agreed court claim amount, and the government attorney’s office pays the legal costs, if any,\u201d Shikwambi said.<\/p>\n

She urged both members of the police and the public to cooperate to avoid unnecessary incidents. \u201cBut note the police in most cases deal with drunken and unruly people, and that makes operations challenging.<\/p>\n

\u201cPolice officers, however, need to be professional and control their tempers, and must not mistreat members of the public in whatever circumstances,\u201d she said. Shikwambi said civil claims against the police are of serious concern.<\/p>\n

Police chief inspector general Sebastian Ndeitunga has in the past often urged police officers to conduct themselves professionally when dealing with members of the public.<\/p>\n

Shikwambi said Ndeitunga has urged all law enforcers to refrain from using unnecessary force and violence during any operation, because it is against the law and their standard operating procedures.<\/p>\n

\u201cMinimum or maximum force must only be applied if and when necessary,\u201d she said. She said alleged misconduct by law-enforcement officers during operations continues to be investigated.<\/p>\n

\u201cThe results indicate that many of these claims have been unfounded and fabricated,\u201d she said.<\/p>\n

\u201cThere seems to be a tendency among members of the public who deliberately get into confrontations with law enforcers to open cases and subsequent lawsuits,\u201d Shikwambi said.<\/p>\n

Perhaps they regard the system as their cash cow, and that must stop, she said. \u201cCooperation from both sides is needed, but the police deal with unruly and drunken people, which makes the operations challenging,\u201d she said.<\/p>\n

Ndeitunga last week told The Namibian he was concerned about the rise in civil cases against police officers. He, however, acknowledged that Namibians have the right to approach the courts if they feel their rights have been violated.<\/p>\n

\u201cThe police may use force when the person is not complying with officers. The person may not be injured or be seriously or slightly injured, and the police will be accused of assault,\u201d Ndeitunga said.<\/p>\n

He said some police officers abuse their powers when dealing with civilians. \u201cThese police officers are individuals who misuse police power,\u201d he said.<\/p>\n

Ndeitunga, however, said the individuals who take the police to court are usually also those who violate and demoralise officers. \u201cThe court must be very strict with those who are violating the law,\u201d he said.<\/p>\n

In August, The Namibian reported that the Ministry of Home Affairs, Immigration, Safety and Security was being sued for N$500 000 by Windhoek resident Eugine Goagoseb, after allegedly being assaulted by a State House guard last year.<\/p>\n

The ministry is also being sued for N$4,4 million by warrant officer Tuyenikelao Mwashindange because police officers allegedly arrested and detained him unlawfully. This incident took place on 2 September 2019.<\/p>\n

The Namibian in September reported that a resident of Onandjaba in the Omusati region is suing the ministry for N$160 000 after the police allegedly unlawfully arrested and detained his nine-year-old son.<\/p>\n

According to court documents filed at the Oshakati High Court, the man (38) claims his son was arrested by police officers on 3 December 2020 with three other people near Okahao in the Omusati region.<\/p>\n

The three were suspected of theft in the Erongo region. The police did not provide the total amount they are being sued for, and did not provide a breakdown of how many cases resorted under the various types of crime either.<\/p>\n

CASES DRAIN TAXPAYERS Last month Namibian Sun reported that taxpayers this year alone forked out at least N$900 000 to pay civilians who have been assaulted by police officers and soldiers during joint police operations since 2019.<\/p>\n

At the time the government agreed to pay Johannes Nduwe N$100 000 in addition to his legal bill for an assault he endured during Operation Kalahari Desert at Goreangab in January 2020. Human rights lawyer Norman Tjombe assisted Nduwe with the case.<\/p>\n

In September, the government agreed to pay another Tjombe client, Jesaja Nelumbu Hango, N$250 000 after being attacked by police officers and soldiers at Swakopmund during the first lockdown last year.<\/p>\n

In addition, the courts ordered the government to pay Hango’s in legal fees amounting to N$100 000. In October, the state agreed to pay N$50 000 to cannabis legalisation advocate Brian Jaftha, who was assaulted during a raid at his premises in April 2019.<\/p>\n

In May this year, the government agreed to pay Luise Mwanyangapo an amount of N$250 000 after she was assaulted by soldiers on 27 April 2019. The government’s legal battles continue with at least another 20 civil lawsuits underway in which civilians are claiming combined damages of around N$20 million, many of which were brought by women and minors.<\/p>\n

Two minors who claim they were assaulted during Operation Kalahari Desert are suing the government for more than N$400 000 in combined damages. Inge Shimoneni, the mother of Benisius Kalola, who was killed by a soldier for filming Kalahari Desert officers, is suing the government for N$1,6 million.<\/p>\n
