Africa-Press – Nigeria. <\/strong><\/span>The All Progressive Congress (APC) has filed a two-ground cross-appeal at the Supreme Court to challenge the judgement of the Court of Appeal for refusal to disqualify the governor of Kano State, Abba Yusuf from contesting election over alleged certificate forgery.<\/p>\n

In the notice of appeal filed by Akin Olujinmi, the APC lawyer, dated Wednesday, the party mentioned two grounds in its cross-appeal.<\/p>\n

\u201cThe Lower Court erred in law when their lordships at page 11 of the judgement held thus:<\/p>\n

\u201cNow whether or not the 2nd Cross Respondent\u2019s Form EC9 exhibit qualifies as a certificate under Section 182[1] [j] of the Constitution of the Federal Republic of Nigeria, 1999 [as amended] isn\u2019t of any utilitarian benefit or value to the cross-appellant,\u201d Olujinmi said.<\/p>\n

Citing the particulars of the errors in the judgement, Olujinmi added, \u201cContrary to the holding of the lower court, a decision on it goes to the issue on non-qualification of the 2nd cross-respondent to contest the election in dispute in this appeal.\u201d<\/p>\n

The APC, however, sought an order from the Supreme Court to allow the cross-appeal.<\/p>\n

Recall that the Court of Appeal had a few weeks ago upheld the decision of the Kano State Governorship Election Petition Tribunal.<\/p>\n

The court declared APC\u2019s Nasiru Gawuna the winner of the March 18 gubernatorial election in Kano.<\/p>\n

But the appellate court partly reversed its decision in the certified true copy of the judgement released four days later.<\/p>\n
