Africa-Press – Nigeria. <\/strong><\/span>The Supreme Court on Friday upheld the election of Mr Caleb Mutfwang as the duly elected governor of Plateau.<\/p>\n

The apex court held that the Court of Appeal made a fundamental error in allowing the All Progressives Congress, APC, to poke its nose into the conduct of the primary election by the Peoples Democratic Party, PDP, and nullified the election unjustly.<\/p>\n

Justice Emmanuel Akomaye Agim who delivered the unanimous judgment said the issue of the primary election was an internal affair of political parties, saying no other party can dabble in it except members of the same party.<\/p>\n

He said the conduct of the ward and local governments\u2019 election was an affair of the State Executive Committee of a political party while the conduct of the primary election for the nomination of a governorship candidate is entirely that of the National Executive Committee of a political party.<\/p>\n

Justice Agim held that there was no issue of irregularities in the ways and manners the Governorship primary election that produced the governor was conducted in Plateau and wondered why that of the ward election was used to nullify the gubernatorial poll.<\/p>\n

The appeal court had in a unanimous decision in November ruled that Muftwang was not sponsored by his party, the Peoples Democratic Party, PDP.<\/p>\n

The appellate court held that Nentawe YilwBada of the All Progressives Congress, APC, won the 18 March 2023 governorship election and therefore upheld his appeal.<\/p>\n

Justice Agim therefore voided and set aside the order of the Court of Appeal that Nentawe Goshwehe, the governorship candidate of the All Progressives Congress (APC) be inaugurated as Plateau State Governor.<\/p>\n

The apex court, therefore, upheld the judgment of the Plateau State Governorship Election Petitions Tribunal which had earlier dismissed the petition of the APC and its governorship candidate, adding that that evidence was even well adduced that an order of Plateau State High Court allegedly disobeyed was indeed obeyed by parties involved.<\/p>\n
