{"id":150068,"date":"2025-02-12T09:13:35","date_gmt":"2025-02-12T08:13:35","guid":{"rendered":"https:\/\/www.africa-press.net\/nigeria\/uncategorized\/apc-national-scribe-osun-ag-bicker-over-court-ruling-on-council-poll"},"modified":"2025-02-15T23:45:03","modified_gmt":"2025-02-15T22:45:03","slug":"apc-national-scribe-osun-ag-bicker-over-court-ruling-on-council-poll","status":"publish","type":"post","link":"https:\/\/www.africa-press.net\/nigeria\/parties\/apc-national-scribe-osun-ag-bicker-over-court-ruling-on-council-poll","title":{"rendered":"APC National Scribe, Osun AG bicker over court ruling on council poll"},"content":{"rendered":"<p><span style=\"color: #ff6600\"><strong>Africa-Press &#8211; Nigeria. <\/strong><\/span>Osun State Government and the All Progressives Congress, APC, have continued to trade words over the interpretation of a Court of Appeal ruling regarding the sacked local government chairmen.<\/p>\n<p>The legal dispute centres on the Appellate Court\u2019s recent judgment in Akure concerning the validity of the 2022 local government elections in Osun State.<\/p>\n<p>The National Secretary of the APC, Dr Ajibola Basiru, has also weighed in on the issue and criticised the state government\u2019s stance.<\/p>\n<p>Basiru, who was a former Attorney General and Commissioner for Justice in the state, stated that the state government\u2019s position undermined the rule of law.<\/p>\n<p>He said, \u201cThis deliberate misrepresentation of the court\u2019s judgment is an affront to the rule of law and exposes the Osun State Government as an enabler of illegality.<\/p>\n<p>\u201cOrdinarily, it is expected that the lawyer, ought to know that there is a presumption of the validity and bindingness of a judgment of the Court until it is set aside.<\/p>\n<p>\u201cThe only option open to a party dissatisfied with the judgment of the Court of Appeal is to challenge it by appeal to the Supreme Court. Neither Alimi nor the Osun State Government can sit on appeal over this judgment. This is elementary law.<\/p>\n<p>\u201cThe Court of Appeal judgment considered all grounds of appeal raised in CA\/AK\/270\/2022 against the judgment of the Federal High Court (Justice N. Ayo-Emmanuel), which had nullified the local government elections and ordered the elected officials to vacate office.<\/p>\n<p>\u201cIn allowing the appeal, all the reliefs sought by APC were granted, including setting aside the judgment of the Federal High Court, and ordering the restoration of the sacked local government councils back to office\u201d, the former Attorney General and Commissioner for Justice in the state stated.<\/p>\n<p>However, the Attorney-General and Commissioner for Justice in Osun State, Jimi Bada, maintained that the court did not reinstate the sacked chairmen.<\/p>\n<p>He clarified that the ruling primarily addressed the case filed by the Action Peoples Party, APP, which challenged the election\u2019s validity.<\/p>\n<p>DAILY POST reports that following the judgment, political parties and stakeholders have engaged in heated exchanges over its implications.<\/p>\n<p>The APC asserted that the court\u2019s decision restored the elected chairmen to their positions, while the Peoples Democratic Party, PDP, and the state government argued otherwise.<\/p>\n<p>The dispute has also involved the Osun State Independent Electoral Commission, which was responsible for conducting the election.<\/p>\n<p>During a press briefing on Tuesday, the Attorney-General reiterated that the court did not order the reinstatement of the sacked officials.<\/p>\n<p>He emphasised that the ruling, which nullified the election in response to the APP\u2019s case, affected all parties involved.<\/p>\n<p>\u201cI want to confirm to you straight away that Court Appeal Akure did not go into the merit of the Appeal launched by the APC before them.<\/p>\n<p>\u201cTheir finding was just that there was no cause of action as at the time PDP brought suit against OSSIEC at the Federal High Court and what the Court of Appeal did was to strike out the originating summon filed by the PDP, and that was all.<\/p>\n<p>\u201cAnybody can be interpreting what the court actually said, but the court did not at any point in time held that any sacked local government Chairmen should go back to office.
