Africa-Press – Nigeria. <\/strong><\/span>The Civil Society Legislative Advocacy Centre (CISLAC) has expressed deep concern over the ongoing institutional crisis between the Police Service Commission (PSC) and the Nigeria Police Force (NPF), which it warns could undermine the rule of law, weaken accountability, and erode public trust in Nigeria\u2019s governance and security institutions.<\/p>\n

In a statement, Auwal Ibrahim Musa (Rafsanjani), Executive Director of CISLAC, reiterated the legal authority of the PSC as outlined in Sections 6 and 7 of the Police Service Commission (Establishment) Act, 2001. He emphasized that the PSC is tasked with the appointment, promotion, dismissal, and disciplinary oversight of personnel within the NPF (excluding the Inspector General of Police). This authority is further supported by Paragraph 30 of Part 1 of the Third Schedule of the 1999 Constitution, which gives the PSC the mandate to oversee police appointments and discipline.<\/p>\n

Rafsanjani pointed to Public Service Rule No. 020908 (i & ii), which mandates the compulsory retirement of public officers, including senior police officers, once they have served for 35 years or reached the age of 60. This rule is intended to maintain the integrity and efficiency of security institutions by promoting leadership renewal and preventing the manipulation of tenure.<\/p>\n

CISLAC strongly condemned the reported directive from the Inspector General of Police (IGP), which instructs senior officers who have met the mandatory retirement criteria to remain in service until further notice. Rafsanjani described this move as a direct violation of the PSC\u2019s statutory authority, arguing that it undermines the separation of powers and creates unnecessary institutional conflicts.<\/p>\n

He also criticized the amendment to the 2020 Police Act, which grants the IGP a fixed four-year tenure, irrespective of age or years of service. Rafsanjani pointed out that this amendment contradicts existing public service regulations and was passed hastily, without a clear legal framework to address tenure disputes. He argued that it has led to arbitrary extensions of office tenure for selected officers.<\/p>\n

Drawing a parallel to past political actions, Rafsanjani likened the current situation to former President Olusegun Obasanjo\u2019s failed attempt to extend his tenure, which the National Assembly rejected in defense of democratic principles. He stressed that legislative processes should be focused on preserving the rule of law and national stability, rather than serving individual interests.<\/p>\n

CISLAC has called for the Inspector General of Police to respect the PSC\u2019s constitutional authority and ensure the immediate retirement of officers who have reached the mandatory service or age limit. The organization also urged the National Assembly to amend the Police Act to clarify the limitations on tenure and prevent conflicts with established service regulations.<\/p>\n

CISLAC further called on President Bola Ahmed Tinubu to intervene and ensure strict adherence to existing laws, preventing the politicization of Nigeria\u2019s security institutions. The organization also urged the judiciary to provide legal clarity on the extent of the IGP\u2019s tenure under the amended Police Act, ensuring compliance with public service regulations.<\/p>\n

CISLAC stressed that the foundation of democracy lies in the rule of law, transparency, and accountability\u2014principles that must remain unwavering. \u201cAllowing tenure manipulation and institutional conflicts to persist will damage the credibility of Nigeria\u2019s security agencies and promote impunity within governance,\u201d Rafsanjani warned.<\/p>\n

For the sake of national security and democratic stability, CISLAC called on all stakeholders\u2014civil society, the media, and the public\u2014to unite against the misuse of legislative and executive powers that threaten institutional integrity. \u201cCISLAC remains committed to advocating for transparent governance, upholding the rule of law, and protecting the independence of oversight institutions in Nigeria,\u201d the statement concluded<\/p>\n
