The document was submitted by NSCIA\u2019s Head of Legal Unit, Barrister Haroun Eze, who also serves as an Imam at the National Mosque, Abuja.<\/p>\n<p>The tax reform bills have sparked intense debates, with Northern leaders and governors expressing concerns that the proposed changes primarily benefit Lagos State and certain interests while potentially marginalizing other regions. The controversy has fueled heated discussions in both chambers of the National Assembly.<\/p>\n<p>In its submission, the NSCIA said its intervention was based on the critical impact of the bills on Nigerians, particularly the Muslim Ummah. It noted that it only became aware of the public hearing through the media on February 24 but deemed it necessary to present its recommendations.<\/p>\n<p>\u201cAs the representative of all Muslims across the country, the NSCIA recommends that all major technical and socio-political issues raised by different sections of the country should be diligently considered and equitably addressed to the satisfaction of all, or at least most, segments of the nation,\u201d the council stated.<\/p>\n<p>The memorandum raised constitutional concerns, particularly regarding provisions that could conflict with Islamic law. Citing the 1999 Constitution (as amended), which provides for the establishment of Shari\u2019a Courts of Appeal for Muslim personal laws such as marriage and inheritance, the NSCIA urged lawmakers to remove any sections of the bills that could undermine these legal principles.<\/p>\n<p>\u201cThe 1999 Constitution of the Federal Republic of Nigeria (as amended) provides for the establishment of Shari\u2019a Courts of Appeal for Muslim personal laws, which include marriage and inheritance. Therefore, all sections of the bills that may directly or indirectly impugn on the law on Shari\u2019a would be unconstitutional and should be removed,\u201d the council stated.<\/p>\n<p>Additionally, the NSCIA recommended replacing the term \u201cecclesiastical\u201d in a section of the bills with \u201creligious\u201d to ensure inclusivity and avoid perceptions of bias.<\/p>\n<p>\u201cThe term \u2018ecclesiastical\u2019 used in a section of the bills should be changed to \u2018religious\u2019 in order not to give the impression that it excludes some religious groups,\u201d the memorandum read.<\/p>\n<p>Despite its concerns, the council reaffirmed its support for the passage of the tax reform bills, provided that its recommendations are taken into account.<\/p>\n<p>\u201cTaking all its recommendations into consideration, the Nigerian Supreme Council for Islamic Affairs recommends the passage of the bills.
