Africa-Press – Nigeria. <\/strong><\/span>Comrade Ighorhiohwunu Aghogho, a Delta-based human rights activist, has pleaded not guilty for the third time to defamation and cyberstalking charges.<\/p>\n

The case, which has been ongoing for over two years, is marked with charge number FHC\/WR\/92C\/2022.<\/p>\n

Aghogho appeared at the Warri Division of the Federal High Court on March 13, where he pleaded not guilty to the six-count charge. The prosecution was led by J.A. Amahi, Esq., from the Delta State Ministry of Justice, while M.R. Ogbodu, Esq., represented Aghogho.<\/p>\n

As the court clerk called the case from the cause list, J.A. Amahi, Esq., representing the Delta State Ministry of Justice, stepped forward for the prosecution. Meanwhile, M.R. Ogbodu, Esq., appeared for Aghogho (the defendant), who pleaded \u201cnot guilty\u201d to the six-count charges.<\/p>\n

Count 1 of the charge read, \u201cThat you, Ighorhiohwunu Aghogho \u2018M\u2019, between the 16th day of September 2019 and the 29th of June 2020, at Warri, within the jurisdiction of this court, intentionally transmitted messages through the internet which you knew to be false for the purpose of causing hatred, ill-will, and injury to one Joshua Omorere \u2018M\u2019, thereby committing an offence punishable under Section 24(b) of the Cybercrime (Prohibition, Prevention, Etc.) Act 2015.\u201d<\/p>\n

Count 2 of the charge read, \u201cThat you, Ighorhiohwunu Aghogho \u2018M\u2019, between the 16th day of September 2019 and the 29th of June 2020, at Warri, within the jurisdiction of this court, intentionally transmitted messages through the internet which you knew to be false for the purpose of causing hatred, ill-will, and injury to one Oghenekevwe Agas \u2018F\u2019, thereby committing an offence punishable under Section 24(b) of the Cybercrime (Prohibition, Prevention, Etc.) Act 2015.\u201d<\/p>\n

Count 3 of the charge read, \u201cThat you, Ighorhiohwunu Aghogho \u2018M\u2019, between the 16th day of September 2019 and the 29th of June 2020, at Warri, within the jurisdiction of this court, intentionally transmitted messages through the internet which you knew to be false for the purpose of causing hatred, ill-will, and injury to the immediate past Chief Judge of Delta State, Hon. Justice Marshal Umukoro (Rtd) \u2018M\u2019, thereby committing an offence punishable under Section 24(b) of the Cybercrime (Prohibition, Prevention, Etc.) Act 2015.\u201d<\/p>\n

Count 4 of the charge read, \u201cThat you, Ighorhiohwunu Aghogho \u2018M\u2019, between the 16th day of September 2019 and the 29th of June 2020, at Warri, within the jurisdiction of this court, intentionally transmitted messages through the internet which you knew to be false for the purpose of causing hatred, ill-will, and injury to the Delta State Commissioner of Police, Ari Mohammed Ari \u2018M\u2019, thereby committing an offence punishable under Section 24(b) of the Cybercrime (Prohibition, Prevention, Etc.) Act 2015.\u201d<\/p>\n

Count 5 of the charge read, \u201cThat you, Ighorhiohwunu Aghogho \u2018M\u2019, between the 16th day of September 2019 and the 29th of June 2020, at Warri, within the jurisdiction of this court, intentionally transmitted messages through the internet which you knew to be false for the purpose of causing hatred, ill-will, and injury to the immediate past Chief Judge of the Federation, Hon. Justice Mohammed Tanko \u2018M\u2019, thereby committing an offence punishable under Section 24(b) of the Cybercrime (Prohibition, Prevention, Etc.) Act 2015.\u201d<\/p>\n

Count 6 of the charge read, \u201cThat you, Ighorhiohwunu Aghogho \u2018M\u2019, between the 16th day of September 2019 and the 29th of June 2020, at Warri, within the jurisdiction of this court, intentionally transmitted messages through the internet which you knew to be false for the purpose of causing hatred, ill-will, and injury to one Fred Ugheni \u2018M\u2019, thereby committing an offence punishable under Section 24(b) of the Cybercrime (Prohibition, Prevention, Etc.) Act 2015.\u201d<\/p>\n

After the \u201cnot guilty\u201d plea was taken, in a dramatic turn of events, the prosecuting counsel argued that the defendant, Aghogho, was not properly before the court due to alleged discrepancies in the affidavit of means provided by his surety. However, the presiding judge, Hon. Justice H.A. Nganjiwa, ultimately overruled the objection, citing the lack of a proper application to substantiate the claim.<\/p>\n

The proceedings began with the defendant taking his plea, after which the prosecuting counsel raised concerns about the validity of the surety\u2019s affidavit. The counsel alleged that the surety had lied about the ownership of a property used as collateral for the defendant\u2019s bail.<\/p>\n

However, the defense counsel attempted to counter the claim, but the prosecution\u2019s objection was overruled by the court, stating that the prosecution did not present any proper application before the court to substantiate the claim.<\/p>\n

The court also overruled the defense counsel\u2019s argument, noting that the prosecution had not presented any reasonable grounds for their objection. The court\u2019s decision effectively paved the way for the plea to be taken and the trial to proceed, despite the prosecution\u2019s attempts to challenge the defendant\u2019s surety.<\/p>\n

The court upheld the submission of the defense counsel, allowing the defendant to rely on his subsisting bail conditions while the trial commences. The case was adjourned to June 16, 2025, for hearing.<\/p>\n

Aghogho\u2019s activism against child trafficking and allegations against government officials led to his arrest and detention in prison for over 600 days without trial, sparking widespread concern over his treatment. He was eventually released on bail in March 2024.<\/p>\n

Meanwhile, the Office of the Honourable Attorney-General of the Federation (HAGF) has directed Aghogho to apply to the court to dismiss the charges.<\/p>\n
