{"id":160219,"date":"2025-04-23T11:15:39","date_gmt":"2025-04-23T10:15:39","guid":{"rendered":"https:\/\/www.africa-press.net\/nigeria\/uncategorized\/legal-expert-counters-sultans-terrorist-tag-on-social-media"},"modified":"2025-04-28T11:45:52","modified_gmt":"2025-04-28T10:45:52","slug":"legal-expert-counters-sultans-terrorist-tag-on-social-media","status":"publish","type":"post","link":"https:\/\/www.africa-press.net\/nigeria\/all-news\/legal-expert-counters-sultans-terrorist-tag-on-social-media","title":{"rendered":"Legal expert counters Sultan\u2019s terrorist tag on social media"},"content":{"rendered":"<p><b>By Hadiza Musa<\/b><\/p>\n<p><span style=\"color: #ff6600\"><strong>Africa-Press &#8211; Nigeria. <\/strong><\/span>Amid growing tension over the role of digital platforms in Nigeria, the Sultan of Sokoto recently stirred controversy by describing social media as a tool worse than a terrorist organization.<\/p>\n<p>Recall that the Sultan stated this last week while speaking during the 7th Executive Committee Meeting of the Northern Traditional Rulers\u2019 Council in Maiduguri, Borno State.<\/p>\n<p>The monarch cited social media\u2019s role in spreading false information and inciting unrest.<\/p>\n<p>\u201cSocial media is one terrorist organisation. Somebody can sit in the comfort of their home and formulate stories and you will consider that it is true.<\/p>\n<p>\u201cSocial media is a terrorist organisation that we must deal with. Security agencies must deal with this terrorist organisation called social media,\u201d the Sultan disclosed.<\/p>\n<p>His remarks sparked widespread reactions across civil society, media, and legal circles particularly at a time when the Nigerian government is considering a bill to regulate social media activities nationwide.<\/p>\n<p>The Sultan\u2019s comparison of social media to terrorism also added fuel to an already heated debate. This is just as civil society groups took to the streets to protest a controversial bill they fear could criminalize online expression.<\/p>\n<p>Just weeks before the Sultan\u2019s comments, the Take It Back movement staged a protest in some parts of the country, voicing strong opposition to the proposed bill, which they say threatens citizens\u2019 rights to free expression and access to information.<\/p>\n<p>Protesters chanted slogans and held placards rejecting what they described as an attempt to silence dissent and shrink civic space under the guise of national security.<\/p>\n<p><b>The Take It Back Movement<\/b><\/p>\n<p>The Take It Back (TIB) Movement is a Nigerian grassroots political and civic organization advocating for social justice, democratic accountability, and systemic reform. Founded by Omoyele Sowore, a journalist and former presidential candidate, the movement has been active since 2018.<\/p>\n<p>The core objectives and activities include;<\/p>\n<p>Advocacy for Good Governance, Support for Workers\u2019 Rights and also Defense of Civil Liberties which actively opposes laws and actions that threaten freedom of speech and assembly, such as the Cybercrime Act and proposed social media regulations.<\/p>\n<p>Over the years, the Nigerian government has made several attempts to regulate digital platforms and social media. In 2015, Senator Bala N\u2019Allah sponsored the \u201cFrivolous Petitions Bill,\u201d which sought to criminalize the posting of abusive statements via SMS or social media without a sworn affidavit. The bill sparked outrage, with many Nigerians viewing it as a threat to free speech. Following intense public backlash, it was eventually withdrawn.<\/p>\n<p>In 2019, another bill titled \u201cProtection from Internet Falsehoods and Manipulations\u201d was introduced, aiming to ban online statements deemed harmful to national security or public confidence. It proposed granting the Nigerian Communications Commission the power to block users and content. Once again, public resistance was fierce, leading to online campaigns like #SayNoToSocialMediaBill, and the bill was also withdrawn.<\/p>\n<p>In more recent developments, the government temporarily banned Twitter in 2021 after it deleted a tweet from former President Buhari, lifting the ban in 2022 after certain conditions were met. Later, in 2022, NITDA introduced a Code of Practice for digital platforms, and by October 2023, the Tinubu administration proposed the \u201cRegulation of Digital Platforms Bill.\u201d This bill, currently before the National Assembly, seeks to give the National Broadcasting Commission the power to oversee social media and combat misinformation online.<\/p>\n<p>Also, several Nigerian political figures and government officials like Nuhu Ribadu, Femi Gbajabiamila, Yemi Osinbajo, Kashim Shettima, Lai Mohammed have publicly criticized social media, expressing concerns about its impact on national unity, security, and the spread of misinformation with the latest being the Sultan describing it as a \u201cterrorist organisation.\u201d<\/p>\n<p>However, numerous individuals and organizations have expressed strong opposition to the regulation of social media, viewing such measures as threats to freedom of expression and democratic engagement.<\/p>\n<p>Groups like, Amnesty International, the Civil Society Legislative Advocacy Centre (CISLAC) and the Yiaga Africa have criticized and opposed the regulation of social media in Nigeria especially when such regulation is seen as a tool to suppress free speech and civic space.<\/p>\n<p><b>You cannot call social media terrorist organization \u2013 Legal Expert<\/b><\/p>\n<p>Barrister Abdulrahman Yusuf, a legal practitioner with Smart Solicitors, has faulted recent claims likening social media platforms to terrorist organizations, stating such comparisons are legally and logically flawed.<\/p>\n<p>In an interview with DAILY POST, Yusuf said, \u201cYou cannot call social media a terrorist organization because it is simply a vast digital space on the internet, not a single entity with one ideology or purpose.\u201d<\/p>\n<p>He explained that under Nigerian law, particularly the Terrorism (Prevention) Act, a terrorist organization refers to a structured group that engages in violence, threatens national security, and seeks to cause a breakdown of law and order or instill fear among the population.<\/p>\n<p>\u201cA terrorist group is one that attacks the government, causes harm to the populace, and tries to instill fear with the aim of destabilizing the country,\u201d Yusuf said.<\/p>\n<p>\u201cBut Twitter, Facebook, Instagram, and other platforms do not fall under this category.\u201d<\/p>\n<p>While acknowledging that some criminal elements, including terrorists and bandits, use social media to spread their propaganda or mobilize support and fake news, Yusuf maintained that this does not justify branding the platforms themselves as terrorist organizations.<\/p>\n<p>\u201cYes, some individuals misuse social media. But that doesn\u2019t mean the platforms are inherently bad. Many Nigerians earn a living, acquire knowledge, and build movements through social media. It is a powerful tool for education, commerce, and civic participation,\u201d he emphasized.<\/p>\n<p>He further urged the Sultan of Sokoto to clarify the context of his controversial remarks.<\/p>\n<p>The Social Media Bill Debate<\/p>\n<p>Speaking on the proposed bill to regulate social media, Yusuf noted that the push stems from growing concerns over fake news, sensationalism, and the potential for online content to incite violence.<\/p>\n<p>\u201cYes, it is very important for us to realize how quickly news spreads on social media.<\/p>\n<p>\u201cThere\u2019s no doubt that misinformation can trigger chaos, disrupt law and order, especially when it concerns sensitive national or social issues. Nigeria is a country that is religiously and culturally diverse, and there is often tension among the various religious sects and cultural groups that make up the country.<\/p>\n<p>\u201cWe\u2019ve seen real-world consequences of fake news and how it has led to rebuttal attacks.\u201d<\/p>\n<p>Yusuf acknowledged the legitimate intentions behind the bill but warned that it could be misused if not carefully crafted.<\/p>\n<p>\u201cThere are sincere reasons behind regulating online spaces, no doubt. But if the bill lacks proper checks and stakeholder engagement, politicians could weaponize it to silence journalism, activism, and public opinion,\u201d he cautioned.<\/p>\n<p>He advocated for a balanced approach in the legislation process; one that recognizes the benefits of digital regulation without undermining constitutional rights.<\/p>\n<p>\u201cThe goal should be to protect citizens from harmful content while also safeguarding their right to free expression,\u201d he said.<\/p>\n<p>\u201cWhat we need is continuous dialogue, inclusive drafting, and legal safeguards.
