Africa-Press – Nigeria. <\/strong><\/span>Former Minister of Finance in the late General Sani Abacha\u2019s regime, Anthony Ani has challenged the legality of the letter of administration issued to Etubom Adolphus Eniang Owong and the Ikot Ani family of Mbiabo Ikoneto over their father\u2019s estate in Mbiabo Ikoneto, in Mbiabo Ikoneto of Odukpani local government area of Cross River state<\/p>\n

A recent Calabar High Court judgement, delivered by Justice Edem Ita Koofre had set aside the letter of Adminstration issued by the probate division of the High Court of Cross River State, to Etubom Adolphus Eniang Owong.<\/p>\n

But the Ikot Ani family of Mbiabo Ikoneto and other stakeholders have filed a stay of execution.<\/p>\n

The letter of administration No.LA\/780\/2010 issued on 14\/12\/2012 and letter of Cross River State judiciary titled issuance of certificate of Additional Assets in the estate of Etubom Etim Eniang Owong (Deceased) dated 21\/2\/2013 and signed by Willie A. Inyang Esq, Chief Registrar, granted ownership of some farmlands to Etubom Adolphus Eniang Owong, who is the next of kin of his late father, was an Etubom and the clan head of Mbiabo Ikoneto for 28 years.<\/p>\n

Justice Koofre, in his judgement averred that the defendant, Etubom Adolphus Eniang Owong was not able to establish the precise nature of the title of his late father\u2019s land in the letter of administration and the certificate of additional Assets, issued him by the probate division of the high court in 2010<\/p>\n

He maintained that the lands in contention are communally owned by the Mbiabo Traditional Council<\/p>\n

However, the second defendant in the suit, the probate division, through its counsel, Dr N..I. Ofem, argued that the contentious farmlands stated in letter of administration did not mean the entire villages of Mbiabo Ikoneto but the specific farmlands inherited and owned by the late Etubom Etim Eniang Owong, the first defendant\u2019s late father, in which he has accordingly deposed to in his affidavit of next of kin, hence the issuance of the letter of administration.<\/p>\n

Counsel to Etubom Adolphus Eniang Owong, Bassey Aikpo, disclosed that they have filed an order of stay of execution of the judgement delivered by Justice Edem Ita Koofre on the 8th of April, 2025 in the suit, pending the hearing and determination of the appeal filed by Etubom Adolphus Eniang Owong, and probate division of the high court, which have been duly served the relevant parties accordingly.<\/p>\n

Also in their reactions, some members of Ikot Ani family, chief Etim Nsa Ani, Chief Offiong Nsa Ani and Chief Ani Ani Nsa, all expressed disappointment at the judgement and described it as a miscarriage of justice for a court to set aside a duly issued letter of administration by a competent court of jurisdiction since 2010<\/p>\n

They recalled that in 2019, the same Anthony Ani was challenged by the Ikot Ani family of Mbiabo Ikoneto, when he attempted to usurp Ikot Ani land for his personal interest in the guise of using it for Basin Development Authority.<\/p>\n
