{"id":172728,"date":"2025-08-06T14:04:29","date_gmt":"2025-08-06T13:04:29","guid":{"rendered":"https:\/\/www.africa-press.net\/nigeria\/uncategorized\/giwa-warns-ibas-against-conducting-lga-elections"},"modified":"2025-08-06T15:08:18","modified_gmt":"2025-08-06T14:08:18","slug":"giwa-warns-ibas-against-conducting-lga-elections","status":"publish","type":"post","link":"https:\/\/www.africa-press.net\/nigeria\/policy\/giwa-warns-ibas-against-conducting-lga-elections","title":{"rendered":"Giwa Warns Ibas Against Conducting LGA Elections"},"content":{"rendered":"<p><span style=\"color: #ff6600\"><strong>Africa-Press &#8211; Nigeria. <\/strong><\/span>The National Coordinator, Advocates People\u2019s Rights and Justice, Victor Giwa, has described as illegal the move by the Rivers State Sole Administrator, Vice Admiral Ibok-E\u0301te\u0300 Ibas (retd.), to conduct Local Government elections in the state.<\/p>\n<p>Giwa pointed out that any election conducted by the Sole administrator would be null and void, insisting that Ibas is not constitutionally allowed to appoint a Chairman for the Rivers State Independent Electoral Commission.<\/p>\n<p>Speaking on Arise News in reaction to the August 30th Local Government Elections in the state, Giwa stated that any election conducted by the Sole Administrator will not stand.<\/p>\n<p>\u201cI am shocked to learn that the Rivers State Sole Administrator appointed the Chairman of the Rivers State Independent Electoral Commission and has even agreed to conduct elections on the 30th of August,\u201d he said.<\/p>\n<p>\u201cHe has no legal authority to do so, as he is not the Governor of the State.<\/p>\n<p>\u201cThe only reason why a sole administrator is appointed is for the prevention of breakdown of law and order, or ensuring that there is peace and order where there is a likelihood of breakdown of order.<\/p>\n<p>\u201cThe general purpose is to ensure that the security of the state, properties and lives are protected.<\/p>\n<p>\u201cI want to submit that under the law the sole administrator cannot, he\u2019s not legally permitted to appoint, firstly, the Chairman of Rivers state Electoral Commission.<\/p>\n<p>\u201cUnder the Rivers state electrical commission law of 2018, that law says that the Chairman&#8230;, the agency, shall compose of seven members, including the chairman, who shall be appointed by the governor of the state, screened and confirmed by the State House of Assembly.<\/p>\n<p>\u201cQuestion, the sole administrator is not a governor of the state. He was not elected under any law. Number two, there is currently no state House of Assembly that can screen and confirm the chairman that he appointed on the eighth of April, 2025.<\/p>\n<p>\u201cSo my submission, therefore, is that the state administrator cannot conduct that election.
