{"id":179783,"date":"2025-09-22T09:47:09","date_gmt":"2025-09-22T08:47:09","guid":{"rendered":"https:\/\/www.africa-press.net\/nigeria\/uncategorized\/fubara-should-seek-redress-for-tenure-extension"},"modified":"2025-09-22T10:49:46","modified_gmt":"2025-09-22T09:49:46","slug":"fubara-should-seek-redress-for-tenure-extension","status":"publish","type":"post","link":"https:\/\/www.africa-press.net\/nigeria\/policy\/fubara-should-seek-redress-for-tenure-extension","title":{"rendered":"Fubara Should Seek Redress for Tenure Extension"},"content":{"rendered":"<p><span style=\"color: #ff6600\"><strong>Africa-Press &#8211; Nigeria. <\/strong><\/span>Nollywood veteran, Kenneth Okonkwo, has said that Governor Siminalayi Fubara of Rivers State should seek redress from the court for tenure extension.<\/p>\n<p>Okonkwo said this on Monday while responding to questions in an interview on Sunrise Daily, a programme on Channels Television.<\/p>\n<p>The politician cum lawyer was reacting to the suspension of the state of emergency in Rivers State and the reinstatement of suspended Governor Fubara, his deputy, and members of the State Assembly.<\/p>\n<p>\u201cThis has nothing to do with antagonizing whoever declared the state of emergency. It has something to do with the constitutional provisions that Fubara was elected by Rivers people to serve them for four years.<\/p>\n<p>\u201cAnd the four years have been interpreted by the Supreme Court to be sacrosanct. That\u2019s why they had staggered election. Now, his six months have been illegally, brutally, without reason, taken away from him. That means you have denied the Rivers people the four years that the Constitution gave them the power to be served by the governor.<\/p>\n<p>\u201cAnd the Constitution is very clear in Section 180(2) that the term of office is four years. So the governor vacates his seat after four years, from the day he was sworn in. So if he leaves by May 29, 2027, he has not served for four years.<\/p>\n<p>\u201cSo what I\u2019m saying is that he has the right to seek redress from the court so that the six months should be added to him. As a matter of fact, when you declare state of emergency, you have to shift elections by six months, assuming there\u2019s a breakdown of law and order.<\/p>\n<p>\u201cSo if Tinubu said there was a breakdown of law and order, which of course is a lie, then he has to extend the tenure by six months, not shorten it.<\/p>\n<p>\u201cSo, I\u2019m saying that Fubara has the right by the Constitution to seek redress as to his term of office, and the Rivers people have the right to be served for four years by Fubara. That\u2019s what they voted him for.
