{"id":18077,"date":"2019-11-25T15:17:10","date_gmt":"2019-11-25T15:17:10","guid":{"rendered":"https:\/\/www.africa-press.com\/nigeria\/?p=18077"},"modified":"2019-11-25T15:17:10","modified_gmt":"2019-11-25T15:17:10","slug":"buhari-has-disobeyed-40-court-orders-says-amnesty-internationals-lawyer","status":"publish","type":"post","link":"https:\/\/www.africa-press.net\/nigeria\/all-news\/buhari-has-disobeyed-40-court-orders-says-amnesty-internationals-lawyer","title":{"rendered":"Buhari Has Disobeyed 40 Court Orders, Says Amnesty International\u2019s Lawyer"},"content":{"rendered":"<p>Dr Kolawole Olaniyan, legal adviser to Amnesty International, has said that President <a href=\"https:\/\/en.wikipedia.org\/wiki\/Muhammadu_Buhari\">Muhammadu Buhari<\/a> has shown \u201cstunning disregard for the rule of law and human rights, ignoring Nigerian judges on at least 40 occasions\u201d.<\/p>\n<p>The London-based lawyer, who accused the President of treating judges with disdain, also questioned the sincerity of Buhari\u2019s anti-corruption fight.<\/p>\n<p>Olaniyan made the claims in a piece titled, \u2018Buhari is ignoring Nigerian judges \u2013 We must not let him get away with it\u2019, according to a report by PUNCH.<\/p>\n<p>He said, \u201cIt\u2019s hard to overstate the significance of this disregard of court orders not just for the operation of the rule of law but also effective respect for constitutional and international human rights, such as freedom of expression, peaceful assembly, association and access to information. Yet, Buhari is carrying on, irrespective of human rights and the rule of law.<\/p>\n<p>\u201cAnytime the courts have told Buhari\u2019s government to do something it doesn\u2019t like, it has refused to obey it.<\/p>\n<p>\u201cEven Buhari\u2019s Attorney-General, Abubakar Malami (SAN), once said the rule of law is what the authorities determine it to be.<\/p>\n<p>\u201cThe government always has explanations on why it should not obey lawful court orders, seemingly replacing binding legal decisions with the vagaries of politics, and obeying the decisions whenever they suit it.<\/p>\n<p>\u201cThis disdainful arrogance for the courts and our constitutional jurisprudence wasn\u2019t even normalised during periods of military dictatorship in Nigeria.<\/p>\n<p>\u201cThe public perception seems to be that the government will only obey court orders if it gets what it wants.<\/p>\n<p>\u201cYet, it should never be right for the government to obey the court as a matter of grace.
