A Federal High Court, sitting in Yenagoa on Thursday sentenced the abductor of Eseoghene Rita Oruru, to 26 years in prison.<\/p>\n
The convict, Yinusa Dahiru, had in 2015 taken Ese, then 13 years old and youngest child of Charles and Rose Oruru, from Yenagoa in Bayelsa State to Kano State.<\/p>\n
DAILY POST gathered that Ese Oruru\u2019s abduction occurred on August 12, 2015 at her mother\u2019s shop in Yenagoa.<\/p>\n
She rejoined her family after the controversy and had since given birth to a baby girl belonging to Yinusa.<\/p>\n
Yinusa, popularly known as Yellow, was subsequently arrested and arraigned in court on a five-count charge of criminal abduction, illicit sex, sexual exploitation and unlawful carnal knowledge of a minor.<\/p>\n
The charges against Yunusa read: \u201cThat you, Yunusa Dahiru, a male, resident in Opolo-Epie area of Yenagoa in Bayelsa State, conspired with the duo of Dankano Mohammed and Mallam Alhassan, between August 2015 and February 2016, to commit an offense of abduction and thereby committed an offense punishable under section 27(a) of the Trafficking in Persons (prohibition) Enforcement and Administration Act, 2015.\u201d<\/p>\n
Count two: \u201cThat you, Yunusa Dahiru, abducted Ese Oruru by means of coercion, transported and harbored her in Kano State and thereby committed an offence punishable under section 13(2)(b) of the Trafficking in Persons (prohibition) Enforcement and Administration Act, 2015.\u201d<\/p>\n
Count three: \u201cThat you, Yunusa Dahiru induced Ese Oruru by the use of deception and coercion to go with you from Yenagoa to Kano State with the intent that she be forced or seduced into illicit intercourse and thereby committed an offense punishable under section 15(a) of the Trafficking in Persons (prohibition) Enforcement and Administration Act, 2015.\u201d<\/p>\n
Count four: \u201cThat you, Yunusa Dahiru, procured Ese Oruru and subjected her to sexual exploitation in Kano State and thereby committed an offense punishable under section 16(1) of the Trafficking in Persons (prohibition) Enforcement and Administration Act, 2015.\u201d<\/p>\n
Count five: \u201cThat you, Yinusa Dahiru, had unlawful carnal knowledge of Ese Oruru without her consent and thereby committed an offense contrary to section 357 of the criminal code Act and punishable under section 358 of the Criminal code ACT, Cap. C.38 laws of the Federation of Nigeria, 2004.\u201d<\/p>\n
Delivering her judgment, in Suit No FHC\/YNG\/17c\/2016, Justice Jane Inyang acquitted him on count one but jailed him five years on (count two), seven years on (count three) and seven years on (count four) and seven years on (count five).<\/p>\n
Justice Inyang said the sentences would run concurrently.<\/p>\n
Yunusa, who appeared in court in handcuffs in a green and white shirt and bathroom slippers, broke down in court after the sentencing.<\/p>\n
Counsel to the Oruru family and immediate past Vice-Chairman of International Federation of Women Lawyers, FIDA, Bayelsa State Chapter, Barr (Mrs) Deme Pamosoo, described the outcome as \u201da just judgement\u201d.<\/p>\n
She commended the judiciary for doing its best to give a good judgement\u201d, adding that it will serve as a deterrent to pedophiles.<\/p>\n
Counsel to Yinusa, Kayode Olaosebikan, said: \u201cI am not comfortable with the part of the judgement that the sentence should run consecutively which invariably means he will spend 24 years in prison, that is the aspect we are not comfortable with, so if at all we want to appeal, that is the aspect but it is dependent on the client, if he is ready to go all the way out\u201d.<\/p>\n
\u201cThough we had some challenges during the course of the trial, there were six other witnesses we needed to have called in this matter, two resident in Bayelsa and four in Kano, but none of them were available. If you look at the judgement, the court gave us ample time to call our witnesses. There were four to five adjournments where the court indulged us to call the witnesses but they were not forthcoming. There was nothing we could do.\u201d<\/p>\n
Speaking after the matter became public, Bala Dahiru, Yinusa\u2019s father, declared that there was no marriage between the two.<\/p>\n
Dahiru spoke at his home in Kauyen Tofa, Kura Local Government in Kano.<\/p>\n
He said: \u201cThere was no marriage between my son and Ese Oruru because it is illegal. I promptly reported the matter to the village head and on their arrival, they were taken to his home who in turn reported to the District Head at Kura.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"
