{"id":3460,"date":"2019-01-28T17:11:59","date_gmt":"2019-01-28T17:11:59","guid":{"rendered":"https:\/\/www.africa-press.com\/nigeria\/?p=3460"},"modified":"2019-01-28T17:11:59","modified_gmt":"2019-01-28T17:11:59","slug":"onnoghen-why-no-court-can-stop-cct-from-trying-cjn-falana","status":"publish","type":"post","link":"https:\/\/www.africa-press.net\/nigeria\/all-news\/onnoghen-why-no-court-can-stop-cct-from-trying-cjn-falana","title":{"rendered":"Onnoghen: Why no court can stop CCT from trying CJN \u2013 Falana"},"content":{"rendered":"<p>A front-line lawyer and human rights activist, Femi Falana SAN, has faulted the decision by the suspended Chief Justice of Nigeria, Walter Onnoghen, to challenge his trial at the Code of Conduct Tribunal, in court.<\/p>\n<div class=\"code-block code-block-2\">\n<div id=\"div-gpt-ad-1524595905268-4\" data-google-query-id=\"CKiSh-X5kOACFYqgewodX7gAnA\">\n<p>Falana, in an interview with Channels Television on Sunday, said that both the Executive and the Judicial arms of government have failed Nigeria.<\/p>\n<p>The Senior Advocate of Nigeria pointed out that Onnoghen himself had stated during the case of Senate President Bukola Saraki and the Federal Government that the CCT was the only forum empowered to try public office holders.<\/p>\n<div class=\"code-block code-block-3\">\n<div id=\"div-gpt-ad-1524595905268-5\" data-google-query-id=\"CKmSh-X5kOACFYqgewodX7gAnA\">\n<p>According to him, \u201cThe judicial arm of government and the Executive arm of government have disappointed Nigerians.<\/p>\n<p>\u201cOnce your client is invited by the police or any law enforcement agency, what we were taught in the law school is that you can accompany your client to the police station; ask for the bail of your client.<\/p>\n<p>\u201cIf the bail is refused, you go to the High Court and ask for bail.<\/p>\n<div class=\"code-block code-block-4\">\n<div id=\"div-gpt-ad-1524595905268-6\" data-google-query-id=\"CKqSh-X5kOACFYqgewodX7gAnA\">\n<p>\u201cBut you cannot by the invitation of your client by the law enforcement agency go to court to say, \u2018thou shall not invite my client; thou shall not investigate my client; thou shall not try my client.\u2019 It is not part of our law.<\/p>\n<p>\u201cThe courts\u2019 injunctions stopping Onnoghen\u2019s trial are wrong under our law. Because by virtue of section 303 of the administration of the Criminal Justice Act, once a trial commences, there shall be no stay of proceedings; no suspension. There\u2019s no way, any court; anywhere; can stop a prosecution before the Code of Conduct Tribunal.<\/p>\n<p>\u201cIn the case of Saraki and the Federal Government, the Chief Justice of Nigeria, Onnoghen, had said that the Code of Conduct Tribunal is the only court; only forum exclusively empowered to deal with issues of code of conduct for public officers.<\/p>\n<p>\u201cSo you cannot go to a national industrial court, Customary Court of Appeal, or Federal High Court, which have no jurisdiction on allegations of bridges of the code of conduct.\u201d<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>A front-line lawyer and human rights activist, Femi Falana SAN, has faulted the decision by the suspended Chief Justice of Nigeria, Walter Onnoghen, to challenge his trial at the Code of Conduct Tribunal, in court.
