{"id":59784,"date":"2022-02-18T18:30:13","date_gmt":"2022-02-18T17:30:13","guid":{"rendered":"https:\/\/www.africa-press.net\/nigeria\/?p=59784"},"modified":"2022-02-18T16:58:22","modified_gmt":"2022-02-18T15:58:22","slug":"abuja-court-strikes-out-suit-seeking-federal-university-vice-chancellors-sack","status":"publish","type":"post","link":"https:\/\/www.africa-press.net\/nigeria\/policy\/abuja-court-strikes-out-suit-seeking-federal-university-vice-chancellors-sack","title":{"rendered":"Abuja court strikes out suit seeking Federal University Vice Chancellor\u2019s sack"},"content":{"rendered":"<p><span style=\"color: #ff6600\"><strong>Africa-Press &#8211; Nigeria. <\/strong><\/span>A Federal High Court in Abuja on Friday struck out a suit seeking to void the appointment of Professor Abayomi Sunday Fasina as the Vice-Chancellor of the Federal University, Oye-Ekiti (FUOYE) in Ekiti state.<\/p>\n<p>Justice Inyang Edem Ekwo, in a judgment, held that the plaintiff \u2013 Tableland Society For the Oppressed (TSFO) \u2013 lacked the locus standi to institute the suit, marked: FHC\/ABJ\/CS\/250\/2021.<\/p>\n<p>Justice Ekwo further held that the plaintiff failed to establish that it was registered by the Corporate Affairs Commission (CAC) to engage in public interest litigation and question the activities of government\u2019s agencies.<\/p>\n<p>The judge, who upheld the defendants\u2019 preliminary objection, denied jurisdiction over the case and proceeded to strike it out.<\/p>\n<p>Listed as defendants in the suit are the Minister of Education, the Federal University, Oye-Ekiti; the Chairman of FUOYE\u2019s Governing Council; the institution\u2019s Registrar; the Chairman, National University Commission and Prof. Fasina.<\/p>\n<p>TSFO had argued among others that Fasina was not qualified for the appointment having allegedly been indicted for wrongdoing and having also not done well in the interview during the selection process.<\/p>\n<p>It accused the university\u2019s Governing Council of manipulating the selection process to favour Fashina.<\/p>\n<p>The plaintiff prayed the court to, among others, void Fasina\u2019s appointment and order the conduct of a fresh appointment process.<\/p>\n<p>The group in court documents stated that \u201cthe 6th defendant (Fasina) was indicted by the committee set up by Ekiti State University Ado-Ekiti for collecting double salary from both Ekiti State University Ado-Ekiti and Federal University Oye-Ekiti.<\/p>\n<p>\u201cSection 42 of the Constitution has been violated by the appointment of the 6th defendant, who failed the selection interview organised.<\/p>\n<p>\u201cThe defendants have all endorsed and unjustly conferred the position of the Vice-Chancellor on the 6th defendant who is not qualified at the expense of qualified candidates purely based on discrimination.<\/p>\n<p>\u201cThe 6th defendant was the worst candidate at the interview, but was unjustly favoured by the 3rd defendant contrary to section 2: 14C of the Federal University, Oye-Ekiti Regulations governing the condition of Service of senior staff.\u201d<\/p>\n<p><strong>For More News And Analysis About <a href=\"https:\/\/www.africa-press.net\/nigeria\">Nigeria<\/a> Follow <a href=\"https:\/\/www.africa-press.net\/\">Africa-Press<\/a><\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Africa-Press &#8211; Nigeria.
