{"id":68482,"date":"2022-07-14T13:02:23","date_gmt":"2022-07-14T12:02:23","guid":{"rendered":"https:\/\/www.africa-press.net\/nigeria\/uncategorized\/breaking-serap-nigerians-defeat-buhari-govt-as-ecowas-court-declares-twitter-ban-unlawful"},"modified":"2022-07-14T14:22:56","modified_gmt":"2022-07-14T13:22:56","slug":"breaking-serap-nigerians-defeat-buhari-govt-as-ecowas-court-declares-twitter-ban-unlawful","status":"publish","type":"post","link":"https:\/\/www.africa-press.net\/nigeria\/policy\/breaking-serap-nigerians-defeat-buhari-govt-as-ecowas-court-declares-twitter-ban-unlawful","title":{"rendered":"BREAKING: SERAP, Nigerians defeat Buhari govt as ECOWAS Court declares Twitter ban unlawful"},"content":{"rendered":"<p><span style=\"color: #ff6600\"><strong>Africa-Press &#8211; Nigeria. <\/strong><\/span>Socio-Economic Rights and Accountability Project (SERAP) and 176 Nigerians have won the Twitter ban case against President Muhammadu Buhari-led administration.<\/p>\n<p>The ECOWAS Court declared the suspension unlawful and cautioned the Nigerian government against a repeat.<\/p>\n<p>SERAP deputy director Kolawole Oluwadare announced the victory after the court sitting on Wednesday.<\/p>\n<p>In 2021, following the deletion of President Buhari\u2019s tweet, the Minister of Information Lai Mohammed announced the suspension of Twitter in Nigeria.<\/p>\n<p>The government threatened to arrest and prosecute users, while the National Broadcasting Commission (NBC) asked all broadcast stations to stop citing Twitter as a news source.<\/p>\n<p>In the judgment, the court declared that it has the jurisdiction to hear the case and that the case was therefore admissible.<\/p>\n<p>The court held that the suspension of Twitter is unlawful and inconsistent with the provisions of Article 9 of the African Charter on Human and Peoples\u2019 Rights and Article 19 of the International Covenant on Civil and Political Rights.<\/p>\n<p>The court said the government\u2019s action violates the rights of SERAP and 176 concerned Nigerians \u201cto the enjoyment of freedom of expression, access to information and the media, as well as the right to fair hearing.\u201d<\/p>\n<p>The court ordered the Buhari administration to take necessary steps to align its policies and other measures to give effect to the rights and freedoms and to guarantee a non-repetition of the unlawful ban.<\/p>\n<p>The court further directed the Buhari administration to bear the costs of the proceedings and directed the Deputy Chief Registrar to supervise.<\/p>\n<p>The applicants\u2019 counsel, Femi Falana commended the judges for unanimously upholding the human rights of community citizens to freedom of expression, and access to information.<\/p>\n<p>The Senior Advocate of Nigeria (SAN) said freedom of expression is not only the cornerstone of democracy but indispensable to a thriving civil society.<\/p>\n<p>Falana expressed hope that West African nations \u201cwill henceforth respect and uphold the human right of community to freedom of expression guaranteed by Article 9 of the African Charter on Human and Peoples Rights\u201d.<\/p>\n<p><strong>For More News And Analysis About <a href=\"https:\/\/www.africa-press.net\/nigeria\">Nigeria<\/a> Follow <a href=\"https:\/\/www.africa-press.net\/\">Africa-Press<\/a><\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Africa-Press &#8211; Nigeria.
