{"id":698,"date":"2017-12-22T10:39:17","date_gmt":"2017-12-22T10:39:17","guid":{"rendered":"http:\/\/africa-press.com\/nigeria\/?p=698"},"modified":"2017-12-22T10:39:17","modified_gmt":"2017-12-22T10:39:17","slug":"abuja-court-throws-fayemi-n3bn-libel-suit-fayoses-media-aide-ekiti-assembly-member","status":"publish","type":"post","link":"https:\/\/www.africa-press.net\/nigeria\/policy\/abuja-court-throws-fayemi-n3bn-libel-suit-fayoses-media-aide-ekiti-assembly-member","title":{"rendered":"Abuja Court throws out Fayemi N3bn libel suit against Fayose\u2019s media aide, Ekiti assembly member"},"content":{"rendered":"<div id=\"nav\">\n<div id=\"og_head\" class=\"\">\n<div id=\"og_q\">\n<div class=\"og_h\">\n<p>A High Court in Abuja has dismissed a N3 billion libel suit filed by<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div id=\"views\">\n<div id=\"cv_\" class=\" dh  \">\n<div class=\"fh\">\n<div class=\"Xg\">\n<div class=\"Qi\">\n<div class=\"Dj\">\n<div class=\"Vh\">\n<div id=\"cvcmsg_16079ccaff6ab478\" class=\"Eh\">\n<div id=\"cvcfullmsg_16079ccaff6ab478\" class=\"bi\">\n<div id=\"cvcmsgbod_16079ccaff6ab478\" class=\"fj\">\n<div class=\"Si\">\n<p>the Minister of Mines and Steel Development, Dr. Kayode Fayemi,<br \/>\nagainst the Ekiti State Governor, Mr Ayodele Fayose&#8217;s spokesman, Lere<br \/>\nOlayinka and the Chairman, Information Committee of the Ekiti State<br \/>\nHouse of Assembly, Dr Samuel Omotoso.<\/p>\n<p>Justice A. O. Ebong dismissed the suit for lack of jurisdiction,<br \/>\nsaying; \u201cBased on the facts as pleaded by the plaintiff in this suit,<br \/>\nI am unable to accept that there was defamation of the plaintiff<br \/>\n(Fayemi) in the FCT, as no publication of the defamatory materials is<br \/>\nshown to have taken place within the FCT. For that reason, this court<br \/>\ncannot exercise jurisdiction in respect of the instant suit. The case<br \/>\nis consequently struck out for want of territorial jurisdiction.\u201d<\/p>\n<p>Fayemi, who is also a former governor of Ekiti State had filed Suit<br \/>\nNumber CV\/577\/2016 before the High Court of the Federal Capital<br \/>\nTerritory, Abuja, claiming that the duo of Olayinka and Omotosodants<br \/>\nbrought disrepute to his name through statements allegedly made by<br \/>\nthem on July 6, 2016, during a live programme tagged Ejiire on Ekiti<br \/>\nState Television, which also aired on cable network, Startimes.<\/p>\n<p>Fayemi, who accused Olayinka of saying that he (Fayemi) illegally<br \/>\ncollected N5 billion from Ecobank in the name of Fountain Holdings for<br \/>\na sham road construction, sought payment of N3 billion for &#8220;aggravated<br \/>\ndamages&#8221; he claimed was caused him by the defendants.<\/p>\n<p>His lawyer, Rafiu Balogun, said through the alleged statements, the<br \/>\ndefendants (Olayinka and Omotoso) portrayed him (Fayemi) as a &#8220;very<br \/>\ncorrupt public office-holder and fraudulent person who siphoned public<br \/>\nfunds at the detriment of Ekiti citizens while serving as governor.&#8221;<\/p>\n<p>However, Olayinka and Omotoso had through their counsel; Ola<br \/>\nOlanipekun (SAN) filed notice of preliminary objection, praying the<br \/>\ncourt to strike out the suit for want of jurisdiction and\/or<br \/>\ncompetence.<\/p>\n<p>Olanipekun said; \u201cIt is trite that a court in one State cannot hear<br \/>\nand determine a matter which lies exclusively within the jurisdiction<br \/>\nof another State.<\/p>\n<p>\u201cThe cause of action and\/or the wrong complained of by the plaintiff<br \/>\noccurred in Ekiti State which is clearly outside the jurisdiction of<br \/>\nthis honorable court.<\/p>\n<p>\u201cThe 1st and 2nd defendants in the suit reside and carry out their<br \/>\nbusinesses in Ekiti State which is outside the jurisdiction of this<br \/>\ncourt.\u201d<\/p>\n<p>Agreeing with the defendants\u2019 preliminary objection, Justice Ebong<br \/>\nsaid it was incumbent on Fayemi to have shown that the statements in<br \/>\nquestion were published within the FCT. He went further to state that<br \/>\nfor the court to have jurisdiction, the plaintiff (Fayemi) must show,<br \/>\nnt merely that the defamatory matter was published to the whole world,<br \/>\nbut that someone within the FCT has read or watched the alleged<br \/>\ndefamatory statements.<\/p>\n<p>Responding to the judgment, Olayinka said; \u201cIt is funny that someone<br \/>\nlike Dr Kayode Fayemi, under whose government Ekiti treasury was<br \/>\nwantonly looted could still have the effrontery to go to court for<br \/>\nlibel. I wished he was put in the witness box and cross examined so<br \/>\nthat pertinent questions bordering on his mis-governance of Ekiti<br \/>\nState will be asked.\u201d<\/p>\n<p>Also in his own reaction, Dr Omotoso said; \u201cThat Fayemi could still go<br \/>\nto court claiming that his character, which he lacked in the first<br \/>\nplace was assassinated show that those claiming to be fighting<br \/>\ncorruption in Abuja are just wasting their time, or at best, fighting<br \/>\nthe opposition.
