Africa-Press – Nigeria. <\/strong><\/span>The Economic and Financial Crimes Commission, EFCC, has been restrained from prosecuting the Chief Executive Officer and founder of the Aiteo Group, Mr Benedict Peters. The restraining order also listed the Attorney-General of the Federation (AGF) and Minister of Justice, Abubakar Malami.<\/p>\n

The injunction was at the behest of the Aiteo CEO who asked the court to restrain the anti-graft agency as well as other United Kingdom courts from further prosecution of him.<\/p>\n

Delivering the judgement, Justice Adegbola Adeniyi granted the relief and extended the restraint to the National Crime Agency (UK) and Crown Prosecution Service (UK), as well as three individuals\u2014Helen Hughes, Stacey Boniface, and John Bavister.<\/p>\n

Judgement in the case which has lasted for five years, having been filed in 2017 by the CEO of Aiteo and three of his companies\u2015Colinwood Limited, Rosewood Investments and Walworth Properties Limited\u2015was delivered on November 2, 2022, in Abuja.<\/p>\n

In the judgement of the suit, marked FCT\/HC\/CV\/0536\/17, as seen on Tuesday, the complainant argued that the defendants were intimidating him, hence, his reason for seeking the intervention of the court to stop them.<\/p>\n

The complainant also contended that his properties were erroneously included in the list of properties allegedly owned by Mrs Diezani Alison-Madueke, the former Minister of Petroleum during President Goodluck Jonathan\u2019s administration.<\/p>\n

Peters argued that despite presenting full proof of his ownership of the properties, the defendants continued to withhold them with the intent to permanently denied him.<\/p>\n

According to him, the defendants\u2019 conduct with regard to his properties was already affecting his business interests.<\/p>\n

The properties according to court papers include: \u201c(i) 270-17 Street, Unit #4204, Atlanta, Georgia (ii) Flat 5 Parkview, 83-86 Prince Albert Road, St John\u2019s Wood, London (iii) Flat 58 Harley House Marylebone, London, and (iv) Apartment 4, 5 Arlington Road, London.\u201d<\/p>\n

In his ruling, the judge cited \u201cdefendants\u2019 misrepresentation of facts\u201d as reasons for restraining them from criminal prosecution of the Aiteo CEO.<\/p>\n

The judge further held that the \u201cpredominant purpose of the deceitful sham allegations by the defendants\u201d with regard to the assets\/properties listed in the relief sought by the complainant was \u201cdirectly intended albeit to inflict economic loss on the claimants.\u201d<\/p>\n

The restraining order was directed at the defendants, and a slew of operatives, officers, agents, and servants.<\/p>\n
