{"id":89570,"date":"2023-06-10T12:11:53","date_gmt":"2023-06-10T11:11:53","guid":{"rendered":"https:\/\/www.africa-press.net\/nigeria\/uncategorized\/tinubus-victory-pepc-admits-peter-obis-video-in-evidence"},"modified":"2023-06-10T13:32:28","modified_gmt":"2023-06-10T12:32:28","slug":"tinubus-victory-pepc-admits-peter-obis-video-in-evidence","status":"publish","type":"post","link":"https:\/\/www.africa-press.net\/nigeria\/policy\/tinubus-victory-pepc-admits-peter-obis-video-in-evidence","title":{"rendered":"Tinubu\u2019s victory: PEPC admits Peter Obi\u2019s video in evidence"},"content":{"rendered":"<p><span style=\"color: #ff6600\"><strong>Africa-Press &#8211; Nigeria. <\/strong><\/span>The Presidential Election Petition Court, PEPC, on Friday admitted two video flash drives in the evidence brought by Mr Peter Obi through a subpoenaed witness to prove his petition against President Bola Tinubu.<\/p>\n<p>Obi and his Labour Party (LP) are petitioners in the petition marked CA\/PEPC\/03\/2023 challenging the election which brought President Bola Tinubu into power.<\/p>\n<p>Respondents are the Independent National Electoral Commission (INEC), President Bola Tinubu, Vice President Kashim Shettima and the All Progressives Congress (APC).<\/p>\n<p>The court admitted two video flash drives tendered through a subpoenaed witness for Obi and his Party.<\/p>\n<p>At the resumed hearing of the petition, Levi Uzoukwu, SAN, counsel for the petitioners, told the court the proceeding would be conducted by Jubrin Okitepa, SAN.<\/p>\n<p>He said the proceeding would also require software engineering.<\/p>\n<p>A subpoenaed witness from Channels TV was called, named Lucky Obowo-Isawode, a reporter and editor.<\/p>\n<p>The counsel informed the court that two subpoenas dated May 30 and June 6 were served on the TV station to produce the video clips.<\/p>\n<p>The video clips, he said, are an interview with the chairman of INEC, Prof. Mahmood Yakubu.<\/p>\n<p>The second one is that of Mr Festus Okoye, National Commissioner and Chairman of the Information and Voter Education Committee of INEC.<\/p>\n<p>The respondents\u2019 counsel are Kemi Pinhero, SAN, for INEC, Akin Olujimi, SAN, for president Tinubu and Vice president Shittema, Afolabi Fashanu, SAN for APC.<\/p>\n<p>They all did not oppose the witness but objected to the adoption of his statement on oath.<\/p>\n<p>Olujimi, for the 2nd and 3rd respondents, objected to the adoption of his witness statement on oath.<\/p>\n<p>According to him, it is against the provision of the Electoral Act<\/p>\n<p>\u201cIt is settled that an election petition must be filed within 21 days after the announcement of the election.<\/p>\n<p>\u201cThe documents sent out must be accompanied by the petition, list of witnesses and their statements.<\/p>\n<p>\u201cThe witness statement was filed today, three months after the announcement of the results,\u201d he said.<\/p>\n<p>He added that he had looked at the pages of the petition and did not see the name of the witness.<\/p>\n<p>\u201cThe witness is not competent to testify before this court, this point has been settled in the decision of this court,\u201d he said.<\/p>\n<p>Pinhero aligned with the submission by Olujimi.<\/p>\n<p>\u201cThe petitioners were aware of the videos and ought to have filed it along with the petition as required by the law,\u201d he said.<\/p>\n<p>He, therefore, urged the court to discountenance the adoption and uphold the objection.<\/p>\n<p>Fashanu for APC aligned with the submissions of the other respondents\u2019 counsel.<\/p>\n<p>He added that there is no distinction between a subpoenaed witness and an ordinary witness for the purposes of compliance.<\/p>\n<p>He, therefore, urged the court to uphold the objection and refuse the adoption for void of merit.<\/p>\n<p>Okitepa told the court if there is something to dismiss, it is the objections of the respondents.<\/p>\n<p>\u201cA subpoena, we know, is an order of the court issued against a person.<\/p>\n<p>\u201cIt is not a witness in control of the petitioner or respondent and is competent to testify.<\/p>\n<p>\u201cIf a subpoenaed witness can testify orally, what injury would we suffer? I submit none.<\/p>\n<p>\u201cIt will rather quicken the hands of justice.<\/p>\n<p>\u201cNo injury should be suffered. I, therefore, urge the court to overrule the objection, you need to see the video,\u201d he said.<\/p>\n<p>He told the court that the evidence the subpoenaed witness brought were Live interviews with INEC chairman and Mr Festus Okoye.<\/p>\n<p>The video\u2019s flash drives were tendered and admitted in evidence and the counsel prayed that it should be played.<\/p>\n<p>Olujimi objected that it should not be played because the flash drive was not served on them.<\/p>\n<p>He submitted that they didn\u2019t know what the contents of the flash drive was and needed to know in order to prepare themselves.<\/p>\n<p>\u201cHaving not served us before the proceeding, it would not be in the interest of fair hearing\u201d, he said.<\/p>\n<p>Fashanu for APC aligned with Olujimi, while Pinhero for INEC said the video can be played since it is already admitted in evidence.<\/p>\n<p>Meanwhile, the five-member panel led by Justice Haruna Tsammani adjourned for the videos to be played and for further hearing of the petition.<\/p>\n<p><strong>For More News And Analysis About <a href=\"https:\/\/www.africa-press.net\/nigeria\">Nigeria<\/a> Follow <a href=\"https:\/\/www.africa-press.net\/\">Africa-Press<\/a><\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Africa-Press &#8211; Nigeria.
