Africa-Press – Nigeria. <\/strong><\/span>A Federal High Court in Abuja has ordered the Central Bank of Nigeria (CBN) to pay Media Rights Agenda (MRA) the sum of one million naira as damages for wrongful denial of access to information.<\/p>\n

The court, as stated in a press statement made available to DAILY POST by MRA, also directed the apex bank to make available to the organisation all the information it requested in its May 22, 2020 letter regarding the bank\u2019s data protection policies and practices.<\/p>\n

MRA had filed a suit on June 15, 2020, through its lawyer, Darlington Onyekwere, challenging CBN\u2019s refusal to disclose the information it applied for.<\/p>\n

MRA had asked the court to compel the bank and its governor to make available the information it requested in its May 22, 2020 letter to the bank in which it asked for, among other things, copies of all the CBN\u2019s data protection policies issued in conformity with the Nigeria Data Protection Regulation (NDPR), 2019.<\/p>\n

Other items demanded by the organisation included names and contact details of the CBN\u2019s Data Protection Officer designated in accordance with the NDPR and its relevant data privacy instruments and data protection directives.<\/p>\n

According to the MRA statement made available by its communications officer, Idowu Adewale, the presiding judge had frowned at the failure of the bank to give written notice to the organisation to access the aforementioned listed documents.<\/p>\n

The judge accordingly issued an order compelling CBN to make all the information requested by MRA available to the organisation.<\/p>\n

\u201cThe judge also ruled that MRA was entitled to damages for the unlawful violation of its right of access to information and granted the organisation\u2019s claim of N1 million as damages,\u201d the statement reads.<\/p>\n

MRA\u2019s request for an order directing the Attorney General of the Federation to initiate criminal proceedings against the CBN for wrongful denial of access to information under Section 7(5) of the FOI Act was, however, denied by the judge.<\/p>\n
