Africa-Press – Senegal. <\/strong><\/span>The draft texts for the application of the law on the status of the artist and cultural professionals were submitted, on Friday, to the various cultural professionals and cultural entrepreneurs for validation in a spirit \u00ab\u00a0inclusive and participatory,\u00a0\u00bb said the Secretary General of the Ministry of Culture and Historical Heritage, Habib Le\u0301on Ndiaye during a workshop.<\/p>\n

Il a explique\u0301 que l\u2019objectif e\u0301tait de faire une pre\u0301-validation technique de ces projets de textes (deux projets de de\u0301crets et de trois projets d\u2019arre\u0302te\u0301s) par les artistes et autres acteurs de la culture afin de recueillir leurs observations et pre\u0301occupations.<\/p>\n

The law on the status of the artist and cultural professionals was voted by the National Assembly on December 30, 2020 and promulgated by the President of the Republic on March 13, 2021. It provides for a right to social protection for cultural actors.<\/p>\n

\u00bbComme tout acte le\u0301gislatif, comme toute loi, il y a des textes d\u2019application notamment des de\u0301crets et des arre\u0302te\u0301s, c\u2019est pour cette raison que nous nous sommes re\u0301unis pour partager avec les acteurs et recueillir leurs observations et pre\u0301occupations dans une de\u0301marche inclusive et participative \u00bb, a indique\u0301 M. Ndiaye lors de l\u2019ouverture de cette rencontre de deux jours a\u0300 Dakar.<\/p>\n

Le projet de de\u0301cret relatif au re\u0301gime de la protection sociale, le projet d\u2019arre\u0302te\u0301s qui porte sur les cartes professionnelles, celui relatif aux me\u0301tiers seront examine\u0301s, a fait savoir Habib Le\u0301on Ndiaye.<\/p>\n

The Secretary General of the Ministry of Culture and Historical Heritage recalled that the process will take some time before the application texts become effective.<\/p>\n

\u201cThese are the intermittence, the discontinuity of activities, what is called pluriactivity, salaried and self-employed workers, the plurality of employers, specific remuneration corresponding to stamps or property rights intellectuals, artistic or literary, etc\u201d, he listed.<\/p>\n

According to him, all this means that the social protection of this sector can only be governed by \u201cspecific provisions\u201d.<\/p>\n

The draft decree relating to the social protection scheme has raised many questions with those involved in culture, in particular on the one-stop shop bringing together the social security fund and the IPRES, on the number of working hours necessary to benefit of social protection and the management of accidents at work and illnesses and also the nature of cultural enterprises.<\/p>\n

For Ngone\u0301 Ndour, producer and president of the Board of Directors of the Senegalese Society of Copyright and Related Rights (Sodav), these texts will make it possible to organize and regulate the sector, most of which is informal. .<\/p>\n

She notes, however, a concern about the professional card. For her, formal cultural enterprises that have a trade register and operate normally do not need a professional card.<\/p>\n
